1 AMENDMENT TO HOUSE BILL 3775
2 AMENDMENT NO. . Amend House Bill 3775 as follows:
3 on page 3, by replacing lines 14 through 33 with the
4 following:
5 "(d) The identity, or any group of facts that which
6 tends to lead to the identity, of any person whose condition
7 or treatment is submitted to the Illinois Health and
8 Hazardous Substances Registry is confidential and shall not
9 be open to public inspection or dissemination. Facts that
10 tend to lead to the identity of a person include the
11 following: name, social security number, address, and any
12 other data element that, by itself or in combination with
13 one or more other data elements, tends to identify any
14 person. The identity of any person or persons claimed to be
15 derived from cancer registry data is not admissible in
16 evidence, and no court shall require information to be
17 produced in discovery if it determines that the information
18 tends to lead to the identity of any person. Information for
19 specific research purposes may be released in accordance with
20 procedures established by the Department. Except as provided
21 by rule, and as part of an epidemiologic investigation, an
22 officer or employee of the Department may interview a patient
23 named in a report made under this Act, or relatives of any

1 such patient, only with the express written consent of the
2 patient.".
