1 HOUSE RESOLUTION
2 WHEREAS, Allegations have been raised regarding the
3 conduct of Supreme Court Chief Justice James D. Heiple; and
4 WHEREAS, Section 14 of Article IV of the Constitution
5 provides that the House of Representatives has the sole power
6 to conduct legislative investigations to determine the
7 existence of cause for impeachment and, by the vote of a
8 majority of the members elected, to impeach Executive and
9 Judicial officers; therefore be it
10 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
11 NINETIETH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that a
12 Special Investigative Committee be created for the purpose of
13 investigating the conduct of Supreme Court Chief Justice
14 James D. Heiple and making a recommendation as to whether
15 cause exists for his impeachment; and be it further
16 RESOLVED, That the Special Investigative Committee shall
17 consist of 6 legislative members, with 3 members of the
18 House of Representatives appointed by the Speaker of the
19 House of Representatives and 3 members of the House of
20 Representatives appointed by the Minority Leader of the House
21 of Representatives; and be it further
22 RESOLVED, That the Speaker of the House of
23 Representatives and the Minority Leader of the House of
24 Representatives shall each designate one appointee to serve
25 as a co-chairperson; and be it further
26 RESOLVED, That the appointments of the members and the
27 designation of the co-chairpersons of the Special
28 Investigative Committee shall be transmitted by the
29 appointing authority in writing to the Clerk of the House of
30 Representatives; and be it further
31 RESOLVED, That the Special Investigative Committee is

1 empowered to meet upon the proper appointment of a majority
2 of the members with all meetings to be public at times and
3 places designated by the co-chairpersons; that advance
4 notice of all meetings shall be given to the public; and that
5 the Special Investigative Committee may gather evidence and
6 hear testimony at any location within the State of Illinois
7 designated by the co-chairpersons; and be it further
8 RESOLVED, That the Special Investigative Committee is
9 empowered to compel the attendance and testimony of persons
10 and the production of papers, documents, and other evidence,
11 under oath, by subpoena signed by the Speaker of the House of
12 Representatives and attested by the Clerk of the House of
13 Representatives when the testimony, documents, or evidence is
14 necessary for or incident to any inquiry relevant to the
15 business or purposes of the Special Investigative Committee,
16 and to punish any person for the neglect, refusal to appear,
17 or failure to produce papers or documents or provide
18 evidence commanded by subpoena or who, upon appearance,
19 either with or without subpoena, refuses to be sworn or
20 testify or produce papers, documents, or evidence demanded of
21 him or her; and be it further
22 RESOLVED, That the Special Investigative Committee may
23 hire staff and contract with legal counsel, agents, and
24 employees as it may deem necessary; and be it further
25 RESOLVED, That, upon the completion of the investigation,
26 the Special Investigative Committee shall submit a final
27 report and its recommendations to the House of
28 Representatives by filing a copy with the Clerk of the House
29 of Representatives before January 1, 1998.
