Amends the Illinois Vehicle Code to provide that funeral
processions have the right-of-way when the vehicles have both
their headlights lighted and their hazard warning signal
flashers flashing (instead of having only their headlights
lighted).

1 AN ACT to amend the Illinois Vehicle Code by changing
2 Section 11-1420.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Vehicle Code is amended by
6 changing Section 11-1420 as follows:

8 Sec. 11-1420. Funeral processions.
9 (a) Funeral processions have the right-of-way at
10 intersections when vehicles comprising such procession have
11 their headlights lighted and their hazard warning signal
12 flashers flashing if the vehicle is equipped with hazard
13 warning signal flashers, subject to the following conditions
14 and exceptions:
15 1. Operators of vehicles in a funeral procession shall
16 yield the right-of-way upon the approach of an authorized
17 emergency vehicle giving an audible or visible signal;
18 2. Operators of vehicles in a funeral procession shall
19 yield the right-of-way when directed to do so by a traffic
20 officer;
21 3. The operator of the leading vehicle in a funeral
22 procession shall comply with stop signs and traffic control
23 signals but when the leading vehicle has proceeded across an
24 intersection in accordance with such signal or after stopping
25 as required by the stop sign, all vehicles in such procession
26 may proceed without stopping, regardless of the sign or
27 signal and the leading vehicle and the vehicles in procession
28 shall proceed with due caution.
29 (b) The operator of a vehicle not in the funeral
30 procession shall not drive his vehicle in the funeral
31 procession except when authorized to do so by a traffic

1 officer or when such vehicle is an authorized emergency
2 vehicle giving audible or visible signal.
3 (c) Operators of vehicles not a part of a funeral
4 procession may not form a procession or convoy and have their
5 headlights lighted or their hazard warning signal flashers
6 flashing for the purpose of securing the right-of-way granted
7 by this Section to funeral processions.
8 (d) The operator of a vehicle not in a funeral
9 procession may overtake and pass the vehicles in such
10 procession if such overtaking and passing can be accomplished
11 without causing a traffic hazard or interfering with such
12 procession.
13 (e) The lead vehicle in the funeral procession may be
14 equipped with a flashing amber light which may be used only
15 when such vehicle is used as a lead vehicle in such
16 procession. Vehicles comprising a funeral procession may
17 utilize funeral pennants or flags or windshield stickers to
18 identify the individual vehicles in such a procession.
