Amends the Illinois Income Tax Act to create tax

Illinois to direct the Department of Human Services to make
grants to organizations in Illinois for research of mental

1 AN ACT concerning income tax checkoffs.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 3. The Department of Human Services Act is
5 amended by adding Section 10-12 as follows:
6 (20 ILCS 1305/10-12 new)
7 Sec. 10-12. Grants to the American Diabetes Association.
8 The Department of Human Services shall make grants to the
9 American Diabetes Association for research on diabetes from
10 appropriations to the Department from the American Diabetes
11 Fund, a special fund created in the State Treasury.
12 Section 5. The Civil Administrative Code of Illinois is
13 amended by adding Sections 55.85 and 55.86 as follows:

15 Sec. 55.85. Grants from the Mental Health Research Fund.
16 From funds appropriated from the Mental Health Research Fund,
17 the Department of Human Services shall award grants to
18 organizations in Illinois, for the purpose of research of
19 mental illness.

21 Sec. 55.86. Children's Cancer Fund; grants. From funds
22 appropriated from the Children's Cancer Fund, a special fund
23 created in the State treasury, the Department of Human
24 Services shall make grants to public or private entities in
25 Illinois, including the Mitchell Ross Children's Cancer Fund
26 and the Cancer Wellness Center, for the purposes of funding
27 (i) research into causes, prevention, and treatment of cancer
28 in children and (ii) direct community-based supportive

1 services and programs that address the psychological,
2 emotional, and social needs of children with cancer and their
3 family members.
4 Section 10. The State Finance Act is amended by adding
5 Sections 5.449, 5.450, and 5.451 as follows:

12 Section 15. The Illinois Income Tax Act is amended by
13 changing Sections 509 and 510 and adding Sections 507R, 507S,
14 and 507T as follows:

16 Sec. 507R. Mental Health Research Fund checkoff. The
17 Department shall print on its standard individual income tax
18 form a provision indicating that if the taxpayer wishes to
19 contribute to the Mental Health Research Fund, as authorized
20 by this amendatory Act of 1997, he or she may do so by
21 stating the amount of the contribution (not less than $1) on
22 the return and that the contribution will reduce the
23 taxpayer's refund or increase the amount of payment to
24 accompany the return. Failure to remit any amount of
25 increased payment shall reduce the contribution accordingly.
26 This Section shall not apply to any amended return.

21 accompany the return. Failure to remit any amount of
22 increased payment shall reduce the contribution accordingly.

25 Sec. 509. Tax checkoff explanations. All individual
26 income tax return forms shall contain appropriate
27 explanations and spaces to enable the taxpayers to designate
28 contributions to the Child Abuse Prevention Fund, to the
29 Community Health Center Care Fund, to the Illinois Wildlife
30 Preservation Fund as required by the Illinois Non-Game
31 Wildlife Protection Act, to the Alzheimer's Disease Research
32 Fund as required by the Alzheimer's Disease Research Act, to

1 the Assistance to the Homeless Fund as required by this Act,
2 to the Heritage Preservation Fund as required by the Heritage
3 Preservation Act, to the Child Care Expansion Program Fund as
4 required by the Child Care Expansion Program Act, to the Ryan
5 White AIDS Victims Assistance Fund, to the Assistive
6 Technology for Persons with Disabilities Fund, to the
7 Domestic Violence Shelter and Service Fund, to the United
8 States Olympians Assistance Fund, to the Youth Drug Abuse
9 Prevention Fund, to the Persian Gulf Conflict Veterans Fund,
10 to the Literacy Advancement Fund, to the Ryan White Pediatric
11 and Adult AIDS Fund, to the Illinois Special Olympics
12 Checkoff Fund, to the Breast and Cervical Cancer Research
13 Fund, to the Korean War Memorial Fund, to the Heart Disease
14 Treatment and Prevention Fund, to the Hemophilia Treatment
15 Fund, to the Mental Health Research Fund, to the Children's
16 Cancer Fund, to the American Diabetes Association Fund, the
17 Women in Military Service Memorial Fund, and to the Meals on
18 Wheels Fund. Each form shall contain a statement that the
19 contributions will reduce the taxpayer's refund or increase
20 the amount of payment to accompany the return. Failure to
21 remit any amount of increased payment shall reduce the
22 contribution accordingly.
23 If, on October 1 of any year, the total contributions to
24 any one of the funds made under this Section do not equal
25 $100,000 or more, the explanations and spaces for designating
26 contributions to the fund shall be removed from the
27 individual income tax return forms for the following and all
28 subsequent years and all subsequent contributions to the fund
29 shall be refunded to the taxpayer.

1 Sec. 510. Determination of amounts contributed. The
2 Department shall determine the total amount contributed to
3 each of the following: the Child Abuse Prevention Fund, the
4 Illinois Wildlife Preservation Fund, the Community Health
5 Center Care Fund, the Assistance to the Homeless Fund, the
6 Alzheimer's Disease Research Fund, the Heritage Preservation
7 Fund, the Child Care Expansion Program Fund, the Ryan White
8 AIDS Victims Assistance Fund, the Assistive Technology for
9 Persons with Disabilities Fund, the Domestic Violence Shelter
10 and Service Fund, the United States Olympians Assistance
11 Fund, the Youth Drug Abuse Prevention Fund, the Persian Gulf
12 Conflict Veterans Fund, the Literacy Advancement Fund, the
13 Ryan White Pediatric and Adult AIDS Fund, the Illinois
14 Special Olympics Checkoff Fund, the Breast and Cervical
15 Cancer Research Fund, the Korean War Memorial Fund, the Heart
16 Disease Treatment and Prevention Fund, the Hemophilia
17 Treatment Fund, the Mental Health Research Fund, the
18 Children's Cancer Fund, the American Diabetes Association
19 Fund, the Women in Military Service Memorial Fund, and the
20 Meals on Wheels Fund; and shall notify the State Comptroller
21 and the State Treasurer of the amounts to be transferred from
22 the General Revenue Fund to each fund, and upon receipt of
23 such notification the State Treasurer and Comptroller shall
24 transfer the amounts.

28 Section 99. Effective date. This Act takes effect upon
29 becoming law.
