65 ILCS 5/7-1-47 from Ch. 24, par. 7-1-47
Amends the Illinois Municipal Code to provide that when
territory is annexed by a municipality that does not provide
by ordinance an automatic zoning classification, then the
territory is automatically zoned at the highest
classification providing principally for residential use (now
automatic zoning only by municipal ordinance). Provides that
territory annexed under an agreement shall be zoned according
to the agreement.

1 AN ACT to amend the Illinois Municipal Code by changing
2 Section 7-1-47.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Municipal Code is amended by
6 changing Section 7-1-47 as follows:
7 (65 ILCS 5/7-1-47) (from Ch. 24, par. 7-1-47)
8 Sec. 7-1-47. Automatic zoning classification. When
9 territory is annexed to a municipality that does not provide
10 by ordinance for automatic zoning in a different manner, the
11 territory is automatically classified to the highest zoning
12 classification providing principally for residential use.
13 Territory annexed to the municipality pursuant to an
14 annexation agreement shall be zoned in accordance with that
15 agreement if it provides a zoning category The corporate
16 authorities of any municipality may provide by ordinance that
17 when territory is annexed to such municipality, the territory
18 automatically is classified to the highest restrictive use
19 under the annexing municipality's zoning ordinance.
