Amends the Counties Code. Provides for the
classification of special uses by a county board. Provides
that special uses may be permitted only after a public
hearing. Provides that a municipality whose boundaries are
within 1 1/2 miles of the area proposed to be classified as a
special use shall be given notice of the hearing and standing
to object to the granting of a special use permit. Provides
that the owner of land immediately touching, or immediately
across a street, alley, or public right-of-way from, the land
to be affected by the special use shall be given notice of
the hearing and standing to object the granting of a special
use permit.

1 AN ACT to amend the Counties Code by adding Section
2 5-12009.5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Counties Code is amended by adding Section
6 5-12009.5 as follows:
7 (55 ILCS 5/5-12009.5 new)
8 Sec. 5-12009.5. Special use authorization. The county
9 board may provide for the classification of special uses.
10 "Special uses" may include but are not limited to public and
11 quasi-public uses affecting the public interest, uses that
12 may have unique, special, or unusual impact upon the use or
13 enjoyment of neighboring property, and planned developments.
14 A use may be a permitted use in one or more zoning districts
15 and a special use in one or more other zoning districts.
16 A special use may be permitted only after a public
17 hearing before the county zoning commission with prior notice
18 given as provided in Section 5-12009 of this Division. A
19 special use shall be permitted only upon evidence that the
20 use meets standards established for the classifications in
21 the ordinances, and the granting of permission therefore may
22 be subject to conditions reasonably necessary to meet the
23 standards.
24 Those municipalities whose boundaries are within 1 1/2
25 miles of any part of the area proposed to be classified as a
26 special use shall be given notice of the hearing. The owner
27 or owners of land immediately touching, or immediately across
28 a street, alley, or public right-of-way from, at least 20% of
29 the perimeter of the land to be affected by the special use
30 shall have standing to object to the granting of a special
31 use permit. A majority vote of the county board is required

1 to grant a special use permit, unless the county board
2 provides by ordinance that a two-thirds vote is required.
