105 ILCS 5/30-9 from Ch. 122, par. 30-9
Amends the School Code. Limits to one the number of
persons a General Assembly member annually may nominate to
receive a General Assembly scholarship. Makes certain family
members of a legislator ineligible for the scholarship which
that legislator is entitled to award. Provides that a
member's failure to make a nomination in any year causes that
scholarship to lapse unless the failure to nominate was for a
scholarship nomination for a year ending before January 1,
1998. Effective January 1, 1998.

1 AN ACT to amend the School Code by changing Section 30-9.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The School Code is amended by changing
5 Section 30-9 as follows:
6 (105 ILCS 5/30-9) (from Ch. 122, par. 30-9)
7 Sec. 30-9. General Assembly scholarship; conditions of
8 admission; award by competitive examination.
9 Beginning with calendar year 1998, each member of the
10 General Assembly may nominate annually one person 2 persons
11 of school age and otherwise eligible, from his district to;
12 one shall receive a certificate of scholarship in the
13 University of Illinois or and the other shall receive a
14 certificate of scholarship in any other State supported
15 university designated by the member. Any member of the
16 General Assembly in making a nomination nominations under
17 this Section may designate that his nominee be granted a 4
18 year scholarship or may instead designate 2 or 4 nominees for
19 that particular scholarship, each to receive a 2 year or a
20 one year scholarship, respectively. The nominee, if a
21 graduate of a school accredited by the University to which
22 nominated, shall be admitted to the university on the same
23 conditions as to educational qualifications as are other
24 graduates of accredited schools. If the nominee is not a
25 graduate of a school accredited by the university to which
26 nominated, he must, before being entitled to the benefits of
27 the scholarship, pass an examination given by the
28 superintendent of schools of the county where he resides at
29 the time stated in Section 30-7 for the competitive
30 examination. The president of each university shall prescribe
31 the rules governing the examination for scholarship to his

2 A member of the General Assembly may award the
3 scholarship by competitive examination conducted under like
4 rules as prescribed in Section 30-7 even though one or more
5 of the applicants are graduates of schools accredited by the
6 university.
7 A member of the General Assembly may delegate to the
8 Illinois Student Assistance Commission the authority to
9 nominate persons for General Assembly scholarships which that
10 member would otherwise be entitled to award, or may direct
11 the Commission to evaluate and make recommendations to the
12 member concerning candidates for such scholarships. In the
13 event a member delegates his nominating authority or directs
14 the Commission to evaluate and make recommendations
15 concerning candidates for General Assembly scholarships, the
16 member shall inform the Commission in writing of the criteria
17 which he wishes the Commission to apply in nominating or
18 recommending candidates. Those criteria may include some or
19 all of the criteria provided in Section 25 of the Higher
20 Education Student Assistance Act. A delegation of authority
21 under this paragraph may be revoked at any time by the
22 member.
23 Failure of a member of the General Assembly to make a
24 nomination in any year shall not cause that scholarship to
25 lapse, except that if the member has failed to make a
26 nomination for a scholarship for any year ending before
27 January 1, 1998, but the member may make a nomination for
28 such scholarship at any time thereafter before the expiration
29 of his term, and the person so nominated shall be entitled to
30 the same benefits as holders of other scholarships provided
31 herein. Any such scholarship for which a member has made no
32 nomination prior to the expiration of the term for which he
33 was elected shall lapse upon the expiration of that term.
34 Notwithstanding any other provision of this Code, a

1 person is not eligible to be nominated or appointed for or
2 awarded or issued a General Assembly scholarship, including
3 but not limited to any vacated or unused portion of a General
4 Assembly scholarship, under this or any other Section of this
5 Article if such person is the spouse, child or other
6 descendant, adopted child or descendant of an adopted child,
7 parent, brother, sister, or descendant of a brother or sister
8 of the General Assembly member who makes the nomination,
9 awards the scholarship, or delegates to the Illinois Student
10 Assistance Commission the authority to nominate a person for
11 a scholarship which that member otherwise would be entitled
12 to award.

14 Section 99. Effective date. This Act takes effect
15 January 1, 1998.
