Amends the Family Practice Residency Act. Provides that
a scholarship recipient who fails to fulfill his or her
designated-shortage-area practice requirement shall pay
interest at 9% per annum on the unpaid balance of the
principal amount required to be paid by the recipient as a
result of that failure.

1 AN ACT to amend the Family Practice Residency Act by
2 changing Section 10.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Family Practice Residency Act is amended
6 by changing Section 10 as follows:
7 (110 ILCS 935/10) (from Ch. 144, par. 1460)
8 Sec. 10. Scholarship recipients who fail to fulfill the
9 obligation described in subsection (d) of Section 3.07 of
10 this Act shall pay to the Department a sum equal to 3 times
11 the amount of the annual scholarship grant for each year the
12 recipient fails to fulfill such obligation. A scholarship
13 recipient who fails to fulfill the obligation described in
14 subsection (d) of Section 3.07 shall have 30 days from the
15 date on which that failure begins, as determined by the
16 Department, within which to pay to the Department the sum
17 required to be paid under this Section. If the full sum is
18 not paid to the Department within that 30 day period, the
19 scholarship recipient shall also be required to pay to the
20 Department interest at the rate of 9% per annum on the amount
21 of that sum from time to time remaining due and unpaid. The
22 amounts paid to the Department under this Section shall be
23 deposited into the Community Health Center Care Fund and
24 shall be used by the Department to improve access to primary
25 health care services as authorized by Section 55.53(a) of the
26 Civil Administrative Code of Illinois.
27 The Department may transfer to the Illinois Development
28 Finance Authority, into an account outside the State
29 treasury, moneys in the Community Health Center Care Fund as
30 needed, but not to exceed an amount established, by rule, by
31 the Department to establish a reserve or credit enhancement

1 escrow account to support a financing program or a loan or
2 equipment leasing program to provide moneys to support the
3 purposes of Section 55.53(a) of the Civil Administrative Code
4 of Illinois. The disposition of moneys at the conclusion of
5 any financing program under this Section shall be determined
6 by an interagency agreement.
