Amends the Illinois Vehicle Code to provide that a law
enforcement officer shall have an uninsured motor vehicle
impounded. The vehicle may be released upon proof of
insurance, the notarized written consent of the vehicle
owner, and reimbursement of impoundment costs.

1 AN ACT to amend the Illinois Vehicle Code by changing
2 Section 3-707.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Vehicle Code is amended by
6 changing Section 3-707 as follows:
7 (625 ILCS 5/3-707) (from Ch. 95 1/2, par. 3-707)
8 Sec. 3-707. Operation of uninsured motor vehicle -
9 penalty.
10 (a) No person shall operate a motor vehicle unless the
11 motor vehicle is covered by a liability insurance policy in
12 accordance with Section 7-601 of this Code.
13 (b) Any person who fails to comply with a request by a
14 law enforcement officer for display of evidence of insurance,
15 as required under Section 7-602 of this Code, shall be deemed
16 to be operating an uninsured motor vehicle.
17 (c) A law enforcement officer shall have an uninsured
18 motor vehicle immediately impounded. The motor vehicle may
19 be released to any licensed driver upon a showing of proof
20 that the motor vehicle is covered by a liability insurance
21 policy in accordance with Section 7-601 of this Code, the
22 notarized written consent for the release by the vehicle
23 owner, and reimbursement of impoundment costs.
24 (d) Any operator of a motor vehicle subject to
25 registration under this Code who is convicted of violating
26 this Section is guilty of a business offense and shall be
27 required to pay a fine in excess of $500, but not more than
28 $1,000. However, no person charged with violating this
29 Section shall be convicted if such person produces in court
30 satisfactory evidence that at the time of the arrest the
31 motor vehicle was covered by a liability insurance policy in

1 accordance with Section 7-601 of this Code. The chief judge
2 of each circuit may designate an officer of the court to
3 review the documentation demonstrating that at the time of
4 arrest the motor vehicle was covered by a liability insurance
5 policy in accordance with Section 7-601 of this Code.
