Amends the Illinois Vehicle Code. Specifically provides
that drivers of buses of any mass transit district or
authority that has a contract agreement with a school
district for student transportation have school bus driver
permits. Provides that these buses are subject to the
special equipment requirements for school buses. Provides
that a school bus driver may not operate or permit operation
of a radio or tape player while students are passengers.

1 AN ACT to amend the Illinois Vehicle Code by changing
2 Sections 6-106.11 and 12-800 and adding Section 12-816.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Vehicle Code is amended by
6 changing Sections 6-106.11 and 12-800 and adding Section
7 12-816 as follows:

9 Sec. 6-106.11. (a) Any individual, corporation,
10 partnership, or association, mass transit district, or mass
11 transit authority who through contractual arrangements with a
12 school district transports students, teachers or other
13 personnel of that district for compensation, shall not permit
14 any person to operate a school bus pursuant to that contract
15 if the driver has not complied with the provisions of
16 Sections 6-106.1 of this Code or such other rules or
17 regulations that the Secretary of State may prescribe for the
18 classification, restriction or licensing of school bus
19 drivers.
20 (b) A violation of this Section is a business offense
21 and shall subject the offender to a fine of no less than
22 $1,000 nor more than $10,000 for a first offense, no less
23 than $1,500 nor more than $15,000 for a second offense, and
24 no less than $2,000 nor more than $20,000 for a third or
25 subsequent offense. In addition to any fines imposed under
26 this subsection, any offender who has been convicted three
27 times under the provisions of subsection (a) shall, upon a
28 fourth or subsequent conviction be prohibited from
29 transporting or contracting to transport students, teachers
30 or other personnel of a school district for a period of five
31 years beginning with the date of conviction of such fourth or

4 Sec. 12-800. Definitions.
5 (a) For the purposes of this Article, the following
6 words and phrases have the meanings ascribed to them as
7 follows:
8 Type I school bus. A school bus with a Gross Vehicle
9 Weight Rating more than 10,000 pounds.
10 Type II school bus. A school bus with a Gross Vehicle
11 Weight Rating of 10,000 pounds or less.
12 Department. The Department of Transportation of the State
13 of Illinois.
14 Gross Vehicle Weight Rating, or GVWR. The value specified
15 by the manufacturer as the loaded weight of the school bus.
16 Rooftop. The major uppermost portion of a bus body that
17 is flat in a fore and after direction.
18 Strobe lamp. A vehicular signaling device that generates
19 flashes of light by inducing intermittent flows of
20 electricity through a gas.
21 (b) For the purposes of this Article, the definition of
22 "school bus" includes the buses of any mass transit district
23 or mass transit authority that has a contract or financial
24 reimbursement agreement with a school or school district for
25 student transportation purposes.

27 Sec. 12-816. Radio or tape player. A school bus driver
28 may not operate or permit operation of a radio or tape player
29 while students are passengers on the school bus. This
30 prohibition applies to a radio or tape player that a school
31 bus is equipped with or a radio or tape player brought onto
32 the school bus by the driver or a passenger. However, this

1 prohibition does not apply to two-way radio communication
2 equipment that a school bus is equipped with.
