Amends the Criminal Code of 1961. Provides that
obstructing justice in furtherance of streetgang related or
gang-related activity is a Class 3 felony (now a Class 4
felony).

1 AN ACT to amend the Criminal Code of 1961 by changing
2 Section 31-4.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Criminal Code of 1961 is amended by
6 changing Section 31-4 as follows:
7 (720 ILCS 5/31-4) (from Ch. 38, par. 31-4)
8 Sec. 31-4. Obstructing justice.
9 A person obstructs justice when, with intent to prevent
10 the apprehension or obstruct the prosecution or defense of
11 any person, he knowingly commits any of the following acts:
12 (a) Destroys, alters, conceals or disguises physical
13 evidence, plants false evidence, furnishes false information;
14 or
15 (b) Induces a witness having knowledge material to the
16 subject at issue to leave the State or conceal himself; or
17 (c) Possessing knowledge material to the subject at
18 issue, he leaves the State or conceals himself.
19 (d) Sentence.
20 (1) Obstructing justice is a Class 4 felony, except
21 as provided in paragraph (2) of this subsection (d).
22 (2) Obstructing justice in furtherance of
23 streetgang related or gang-related activity, as defined
24 in Section 10 of the Illinois Streetgang Terrorism
25 Omnibus Prevention Act, is a Class 3 felony.
