105 ILCS 5/29-3.1 from Ch. 122, par. 29-3.1
Amends the School Code. Provides for State reimbursement
to school districts for the cost of providing pupil
transportation on educational field trips. Defines an
educational field trip. Limits the aggregate reimbursement
for all school districts for their educational field trips to
$2,000,000 per fiscal year. Effective immediately.

1 AN ACT to amend the School Code by changing Section
2 29-3.1.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The School Code is amended by changing
6 Section 29-3.1 as follows:
7 (105 ILCS 5/29-3.1) (from Ch. 122, par. 29-3.1)
8 Sec. 29-3.1. Transportation to and from school sponsored
9 activities.
10 (a) The school board of any school district that
11 provides transportation for pupils to and from the school
12 attended may provide transportation for pupils to and from
13 any school sponsored activities in which pupils of the
14 district participate, whether during the school year or not,
15 and may make a charge for such transportation in an amount
16 not to exceed the cost thereof, which may include a
17 reasonable allowance for depreciation of the vehicles so
18 used. The school board may provide transportation for pupils
19 on bona fide field trips in Illinois or adjacent states.
20 (b) Beginning with the 1997-1998 school year, the cost
21 of providing transportation for pupils on an educational
22 field trip shall be subject to reimbursement by the State
23 under Section 29-5 as transportation to and from an
24 attendance center. As used in this subsection, an
25 "educational field trip" means a one-day field trip: (i)
26 which is sponsored by the school board of a school district,
27 takes place on a regular school day, and begins and ends on
28 that day at an attendance center within the district; and
29 (ii) in which pupils of the school district are required to
30 participate as part of an instructional program and
31 corresponding curriculum of the district that address the

1 State Goals for Learning included in the district's school
2 improvement process. An educational field trip as defined
3 for purposes of this subsection must be designed to
4 contribute to the successful achievement of learning outcomes
5 that address the content of one or more State Goals for
6 Learning. Transportation of pupils to or from a recreational
7 program shall not be deemed to constitute transportation for
8 pupils on an educational field trip within the meaning of
9 this subsection. The total of the reimbursements made to
10 school districts for the cost of providing transportation for
11 pupils on educational field trips for any fiscal year shall
12 not exceed $2,000,000. If the total school district claims
13 for such reimbursement for any fiscal year exceed $2,000,000,
14 reimbursement of those claims shall be made on a prorated
15 basis. If the total of the reimbursements made to school
16 districts for the cost of providing transportation for pupils
17 on educational field trips for any fiscal year is less than
18 $2,000,000, the moneys not needed for such reimbursement
19 shall be used for other transportation reimbursements under
20 Section 29-5. The State Board of Education shall annually
21 report to the General Assembly on the cost of reimbursing
22 school districts for providing transportation for pupils on
23 educational field trips as provided in this Section.
