Amends the Illinois Horse Racing Act of 1975. Provides
that any racetrack shall be exempt from making the
charitable contribution for backstretch workers required by
the Act for years where no live racing is conducted at that
track. Effective immediately.

1 AN ACT to amend the Illinois Horse Racing Act of 1975 by
2 changing Section 31.1.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Horse Racing Act of 1975 is
6 amended by changing Section 31.1 as follows:
7 (230 ILCS 5/31.1) (from Ch. 8, par. 37-31.1)
8 Sec. 31.1. (a) Organization licensees collectively shall
9 contribute annually to charity the sum of $750,000 to
10 non-profit organizations that provide medical and family,
11 counseling, and similar services to persons who reside or
12 work on the backstretch of Illinois racetracks. These
13 contributions shall be collected as follows: (i) no later
14 than July 1st of each year the Board shall assess each
15 organization licensee, (except those tracks which are not
16 within 100 miles of another track each other which tracks
17 shall pay $30,000 annually apiece into the Board charity fund
18 and except any track that did not conduct live racing during
19 the previous year which track shall make no payment under
20 this Section), that amount that equals $750,000 less any
21 payments required to be made by another track which equals
22 $690,000 multiplied by the amount of pari-mutuel wagering
23 handled by the organization licensee in the year preceding
24 assessment and divided by the total pari-mutuel wagering
25 handled by all Illinois organization licensees, (except those
26 tracks which are not within 100 miles of another track and
27 except any track that did not conduct live racing during the
28 previous year) another track, in the year preceding
29 assessment; (ii) notice of the assessed contribution shall be
30 mailed to each organization licensee; (iii) within thirty
31 days of its receipt of such notice, each organization

1 licensee shall remit the assessed contribution to the Board.
2 If an organization licensee wilfully fails to so remit the
3 contribution, the Board may revoke its license to conduct
4 horse racing.
5 (b) No later than October 1st of each year, any
6 qualified charitable organization seeking an allotment of
7 contributed funds shall submit to the Board an application
8 for those funds, using the Board's approved form. No later
9 than December 31st of each year, the Board shall distribute
10 all such amounts collected that year to such charitable
11 organization applicants.

13 Section 99. Effective date. This Act takes effect upon
