Amends the Cook County Article of the Pension Code.
Provides that the remarriage of the surviving spouse of a
county police officer does not operate to terminate the
surviving spouse benefit if the remarriage occurs on or after
the effective date of this amendatory Act. Amends the State
Mandates Act to require implementation without reimbursement.
Effective immediately.

1 AN ACT to amend the Illinois Pension Code by changing
2 Section 9-149 and to amend the State Mandates Act.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Pension Code is amended by
6 changing Section 9-149 as follows:
7 (40 ILCS 5/9-149) (from Ch. 108 1/2, par. 9-149)
8 Sec. 9-149. Widow's marriage to terminate annuity;
9 exception. A widow's annuity shall terminate when she
10 remarries, except in the case of the remarriage of the
11 surviving spouse of a county police officer occurring on or
12 after the effective date of this amendatory Act of 1997. If
13 she has not received, in form of annuity, an amount equal to
14 the total sums accumulated and credited from the employee's
15 contributions and applied for the widow's annuity, the
16 difference between such accumulated annuity credits and the
17 amount received by her in annuity payments shall be refunded
18 to her; provided that if a reversionary annuity is payable to
19 her or to any other person designated by the employee, such
20 aforesaid amount shall not be refunded, but the reversionary
21 annuity shall be payable.
22 The changes to this Section made by this amendatory Act
23 of 1997 apply without regard to whether the deceased county
24 police officer was in service on or after the effective date
25 of this amendatory Act.

27 Section 90. The State Mandates Act is amended by adding
28 Section 8.21 as follows:

1 Sec. 8.21. Exempt mandate. Notwithstanding Sections 6
2 and 8 of this Act, no reimbursement by the State is required
3 for the implementation of any mandate created by this
4 amendatory Act of 1997.
5 Section 99. Effective date. This Act takes effect upon
6 becoming law.
