1 AMENDMENT TO SENATE BILL 950
2 AMENDMENT NO. . Amend Senate Bill 950 on page 1, by
3 replacing lines 21 through 23 with the following:
4 "(4) a violation of Section 6-101 relating to operating
5 a motor vehicle without a valid license or permit;"; and
6 on page 1, line 29, by replacing "15" with "30"; and
7 on page 2, by deleting lines 6 and 7; and
8 on page 2, line 8, by replacing "(11)" with "(10)"; and
9 on page 2, line 11, by replacing "(12)" with "(11)"; and
10 on page 2, line 14, by replacing "(13)" with "(12)"; and
11 on page 2, line 16, by replacing "(14)" with "(13)"; and
12 on page 2, lines 21 and 22, by deleting ", that the Secretary
13 of State determines by administrative rule to be serious";
14 and
15 on page 2, below line 22, by inserting:
16 "(c) A violation of any of these defined serious traffic
17 offenses shall not preclude the defendant from being eligible
18 to receive an order of court supervision under Section 5-6-1
19 of the Unified Code of Corrections."; and

1 on page 3, line 6, after "course", by inserting "and except
2 that an instruction permit may be issued to a child who is at
3 least 15 years and 6 months of age, is enrolled in school,
4 meets the educational requirements of the Driver Education
5 Act, and has passed examinations the Secretary of State in
6 his or her discretion may prescribe"; and
7 on page 5, line 16, after "licenses", by inserting "for
8 persons 18 years of age or older"; and
9 on page 5, line 19, after "person", by inserting "18 years of
10 age or older"; and
11 on page 5, line 28, after "driver" by inserting "who is 21
12 years of age or older,"; and
13 on page 6, line 1, after "cycle", by inserting "or
14 motorcycle"; and
15 on page 6, line 1, by replacing "21" with "18"; and
16 on page 6, line 4, after "motorcycle operator", by inserting
17 "with the same or greater classification, who is 21 years of
18 age or older and who has at least one year of driving
19 experience"; and
20 on page 8, line 17, by replacing "or permit" with "or
21 permit"; and
22 on page 8, line 21, by replacing "or" with "and no graduated
23 driver's license or permit shall be issued to any applicant
24 under 18 years of age"; and
25 on page 9, by replacing lines 9 and 10 with "of 18 years
26 shall operate any motor vehicle, except a motor driven cycle
27 or motorcycle, with"; and
28 on page 22, line 31, after "license", by inserting "or
29 permit"; and

1 on page 22, line 32, by replacing "Section" with "Sections
2 6-107.1 and"; and
3 on page 36, by replacing lines 19 and 20 with "any motor
4 vehicle, except a motor driven cycle or motorcycle, with more
5 than one"; and
6 on page 36, line 23, after "belts", by inserting ", except
7 that each driver under the age of 18 years operating a second
8 division vehicle having a gross vehicle weight rating of
9 8,000 pounds or less that contains only a front seat may
10 operate the vehicle with more than one passenger in the front
11 seat, provided that each passenger is wearing a properly
12 adjusted and fastened seat safety belt"; and
13 on page 42, by replacing lines 4 through 18 with:
14 "(h) The provisions of paragraph (c) shall not apply to
15 a defendant under the age of 21 years charged with violating
16 a serious traffic offense as defined in Section 1-187.001 of
17 the Illinois Vehicle Code:
18 (1) unless the defendant, upon payment of the
19 fines, penalties, and costs provided by law, agrees to
20 attend and successfully complete a traffic safety program
21 approved by the court under standards set by the
22 Conference of Chief Circuit Judges. The accused shall be
23 responsible for payment of any traffic safety program
24 fees. If the accused fails to file a certificate of
25 successful completion on or before the termination date
26 of the supervision order, the supervision shall be
27 summarily revoked and conviction entered. The provisions
28 of Supreme Court Rule 402 relating to pleas of guilty do
29 not apply in cases when a defendant enters a guilty plea
30 under this provision; or
31 (2) if the defendant has previously been sentenced
32 under the provisions of paragraph (c) on or after January
33 1, 1998 for any serious traffic offense as defined in

1 Section 1-187.001 of the Illinois Vehicle Code.".
