Amends the Consumer Fraud and Deceptive Business
Practices Act. Provides that the sale of telecommunications
calling time on a prepaid basis may not include a requirement
that the purchaser must use the prepaid calling time within a
specified time period. Provides that a violation is a
business offense subject to a fine of not more than $5,000.

1 AN ACT to amend the Consumer Fraud and Deceptive
2 Practices Act by adding Section 2II.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Consumer Fraud and Deceptive Business
6 Practices Act is amended by adding Section 2II as follows:
7 (815 ILCS 505/2II new)
8 Sec. 2II. Sales of telecommunications services on a
9 prepaid basis.
10 (a) Sales of telecommunications calling time on a
11 prepaid basis may not include, as a condition of the sale or
12 contract for sale, that the consumer must use the prepaid
13 calling time within a specified time period.
14 (b) A person who violates the provisions of this Section
15 commits an unlawful practice within the meaning of this Act.
16 A person who violates the provisions of this Section commits
17 a business offense may be fined not less than $501 nor more
18 than $5,000 for each offense.
