New Act
Creates the Chicago Express Partnership Program Act.
Allows private businesses and organizations to adopt a
section of an expressway within the greater Chicago region
for the purpose of litter collection, graffiti removal, and
landscape beautification projects. Provides that the Program
shall be marketed and administered solely by the Chicago
Gateway Green Committee. Provides that the participants in
the Program shall be Gateway, landscape maintenance vendors,
the Department of Transportation, the local municipality, and
qualifying businesses or organizations. Provides that the
sponsoring jurisdiction, in conjunction with the Department
and Gateway, shall establish the terms and procedures for
applying for participation and shall be responsible for
determining acceptance or rejection. Provides for
requirements concerning the agreement with the participating
group and signs. Lists the responsibilities of Gateway, the
participating group, and the sponsoring jurisdiction.

1 AN ACT in relation to the Chicago Express Partnership
2 Program.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 1. Short title. This Act may be cited as the
6 Chicago Express Partnership Program Act.
7 Section 5. Purpose. The Chicago Express Partnership
8 Program is created to allow private businesses and
9 organizations to adopt a section of an expressway within the
10 greater Chicago region for the purpose of litter collection,
11 graffiti removal, and landscape beautification projects.
12 This Act sets forth the uniform guidelines and requirements
13 for the administration of the Chicago Express Partnership
14 Program.
15 Section 10. Definitions. For purposes of this Act:
16 "Adopted section" means a length of municipal, township,
17 or county right-of-way and a length of State right-of-way
18 identified by the Illinois Department of Transportation and
19 sponsoring jurisdiction as a safe, adoptable section of
20 right-of-way located within the corporate limits of a
21 municipality.
22 "Department" means the Department of Transportation of
23 this State.
24 "Gateway" means the Chicago Gateway Green Committee.
25 "Graffiti" means any unauthorized painting, drawing, or
26 writing on or near any expressway structure.
27 "Group" means members or employees of civic or
28 not-for-profit organizations and commercial or private
29 enterprises who have requested to participate in or are
30 participating in the Chicago Express Partnership Program.

1 "Litter" means any unsightly or offensive matter.
2 "Sponsoring jurisdiction" means any municipality,
3 township, or county that establishes an Express Partnership
4 Program within its jurisdictional area.
5 Section 15. Administration. The Chicago Express
6 Partnership Program shall be marketed and administered solely
7 by Gateway. The program shall be directed towards all
8 expressways within the borders of the City of Chicago, with
9 eventual inclusion of all expressways in the 6-county area of
10 Northeast Illinois.
11 Section 20. Participation. The participants in the
12 Chicago Express Partnership Program shall be Gateway,
13 certified and pre-approved landscape maintenance vendors, the
14 Department, the local municipality, and qualifying businesses
15 or organizations. No volunteers will be utilized in the
16 Chicago Express Partnership Program.
17 Section 25. Agreement.
18 (a) The sponsoring jurisdiction, in conjunction with the
19 Department and Gateway, shall establish the terms and
20 procedures groups must follow in applying for participation
21 in the program.
22 (b) The sponsoring jurisdiction, in conjunction with the
23 Department and Gateway, shall be responsible for determining
24 whether an application for participation is rejected or
25 accepted. If an application is approved, the group shall
26 execute a written agreement with the sponsoring jurisdiction
27 and Gateway that provides for the group's participation in
28 the Chicago Express Partnership Program.
29 (c) The agreement shall be in the form prescribed by the
30 sponsoring jurisdiction and shall contain the following:
31 (1) agreement that all approved vendors comply with

1 the Department's insurance requirements;
2 (2) agreement that all participants follow
3 guidelines laid forth in the Illinois Adopt-A-Highway
4 Act;
5 (3) agreement that all approved vendors comply with
6 permitting requirements currently in place on the highway
7 permit application; and
8 (4) agreement that all approved vendors shall
9 assume all liability for and hold the State, the State's
10 agents or employees, the sponsoring jurisdiction, the
11 sponsoring jurisdiction's agents or employees, and
12 Gateway harmless from any and all claims of action
13 resulting from the group's work in the program, except
14 where there is negligence involved.
15 Section 30. Responsibilities of Gateway. Gateway shall:
16 (1) Provide administrative, management, and oversight
17 services for the Chicago Express Partnership Program;
18 (2) administer and allocate incoming and outgoing funds
19 related to operation of the program; and
20 (3) participate in decision-making activities in
21 conjunction with the Department and the sponsoring
22 jurisdiction.
23 Section 35. Responsibilities of the group. Groups
24 participating in the Chicago Express Partnership Program
25 shall:
26 (1) be required to contract with approved landscape
27 maintenance vendors for litter and graffiti removal;
28 (2) be required to obey and abide by all laws and
29 regulations relating to safety and any other terms and
30 conditions required by the sponsoring jurisdiction;
31 (3) be required to follow all safety guidelines
32 currently in effect for the Illinois Adopt-A-Highway program;

1 (4) be required to abide by all participant guidelines
2 laid forth in the Illinois Adopt-A-Highway program;
3 (5) be required to submit a copy of their standard
4 operating procedures safety regulations; and
5 (6) be required to follow all of the Department's
6 applicable permitting rules.
7 Section 40. Responsibilities of the sponsoring
8 jurisdiction. The sponsoring jurisdiction shall:
9 (1) determine the specific section of expressway that is
10 adopted; and
11 (2) erect a recognition sign to be supplied by the
12 Department at the site of the adopted section of expressway
13 displaying the name or logo or both of the sponsoring
14 business or organization.
15 Section 45. Signs. Standard signs shall be supplied by
16 the Department, expensed to the Chicago Express Partnership
17 Program. Signs shall have the following uniform
18 characteristics:
19 (1) a white background with custom insert panels to
20 include logos and stylized lettering;
21 (2) use of fluorescent, neon, reflective, or day glow
22 surfaces or lighting shall be prohibited;
23 (3) a panel indicating "section available" shall be
24 displayed if a segment of the expressway is available for
25 sponsorship through the Chicago Express Partnership Program;
26 and
27 (4) no product name, address, or other contact
28 information for the group shall be displayed on the sign.
29 Section 999. Effective date. This Act takes effect upon
30 becoming law.
