1 AMENDMENT TO SENATE BILL 1664
2 AMENDMENT NO. . Amend Senate Bill 1664 on page 1, by
3 replacing line 5 with the following:
4 "Sections 2-3.115 and 10-20.12a as follows:"; and
5 on page 2, by inserting below line 6 the following:
6 "(105 ILCS 5/10-20.12a) (from Ch. 122, par. 10-20.12a)
7 Sec. 10-20.12a. Tuition for non-resident pupils. To
8 charge non-resident pupils who attend the schools of the
9 district tuition in an amount not exceeding 110% of the per
10 capita cost of maintaining the schools of the district for
11 the preceding school year.
12 Such per capita cost shall be computed by dividing the
13 total cost of conducting and maintaining the schools of the
14 district by the average daily attendance, including tuition
15 pupils. Depreciation on the buildings and equipment of the
16 schools of the district, and the amount of annual
17 depreciation on such buildings and equipment shall be
18 dependent upon the useful life of such property.
19 The tuition charged shall in no case exceed 110% of the
20 per capita cost of conducting and maintaining the schools of
21 the district attended, as determined with reference to the
22 most recent audit prepared under Section 3-7 which is

1 available at the commencement of the current school year.
2 Non-resident pupils attending the schools of the district for
3 less than the school term shall have their tuition
4 apportioned, however pupils who become non-resident during a
5 school term shall not be charged tuition for the remainder of
6 the school term in which they became non-resident pupils.
7 Unless otherwise agreed to by the parties involved and
8 where the educational services are not otherwise provided
9 for, educational services for an Illinois student under the
10 age of 21 in a residential program designed to correct
11 alcohol or other drug dependencies shall be provided by the
12 district in which the facility is located and financed as
13 follows. The cost of educational services shall be paid by
14 the district in which the student resides in an amount equal
15 to the cost of providing educational services in a treatment
16 facility. Payments shall be made by the district of the
17 student's residence and shall be made to the district wherein
18 the facility is located no less than once per month unless
19 otherwise agreed to by the parties. These provisions do not
20 apply to any disabled child eligible for special education
21 services under Article 14.
