Amends the Chicago Teacher Article of the Pension Code.
Removes the prohibition on participating in the Fund while
simultaneously participating in one of the other public
employee retirement systems because of a second job.
Validates prior service and contributions for certain persons
currently participating. Amends the State Mandates Act to
require implementation without reimbursement. Effective
immediately.

1 AN ACT to amend the Illinois Pension Code by changing
2 Section 17-106 and to amend the State Mandates Act.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Pension Code is amended by
6 changing Section 17-106 as follows:

8 Sec. 17-106. Contributor, member or teacher.
9 "Contributor", "member" or "teacher": All members of the
10 teaching force of the city, including principals, assistant
11 principals, the general superintendent of schools, deputy
12 superintendents of schools, associate superintendents of
13 schools, assistant and district superintendents of schools,
14 members of the Board of Examiners, all other persons whose
15 employment requires a teaching certificate issued under the
16 laws governing the certification of teachers, any
17 educational, administrative, professional, or other staff
18 employed in a charter school operating in compliance with the
19 Charter Schools Law who is certified under the law governing
20 the certification of teachers, and employees of the Board,
21 but excluding persons contributing concurrently to any other
22 public employee pension system in Illinois for the same
23 employment or receiving retirement pensions under another
24 Article of this Code for that same employment (unless the
25 person's eligibility to participate in that other pension
26 system arises from the holding of an elective public office,
27 and the person has held that public office for at least 10
28 years), persons employed on an hourly basis, and persons
29 receiving pensions from the Fund who are employed temporarily
30 by an Employer for 100 days or less in any school year and
31 not on an annual basis.

1 In the case of a person who has been making contributions
2 and otherwise participating in this Fund prior to the
3 effective date of this amendatory Act of 1998 1991, and whose
4 right to participate in the Fund is established or confirmed
5 by this amendatory Act, such prior participation in the Fund,
6 including all contributions previously made and service
7 credits previously earned by the person, are hereby
8 validated.

11 Section 90. The State Mandates Act is amended by adding
12 Section 8.22 as follows:
13 (30 ILCS 805/8.22 new)
14 Sec. 8.22. Exempt mandate. Notwithstanding Sections 6
15 and 8 of this Act, no reimbursement by the State is required
16 for the implementation of any mandate created by this
17 amendatory Act of 1998.
18 Section 99. Effective date. This Act takes effect upon
19 becoming law.
