1 AMENDMENT TO SENATE BILL 1711
2 AMENDMENT NO. . Amend Senate Bill 1711 as follows:
3 by replacing lines 31 through 34 on page 2 and lines 1
4 through 14 on page 3 with the following:
5 "(b) To the extent permitted under federal law, any
6 person found guilty of a first violation of this Article or
7 of any law of the United States or of any state which is
8 substantially similar to Sections 8A-2 through 8A-5 for
9 violations related to public assistance or medical assistance
10 programs of the kind provided under this Code may be
11 suspended from eligibility for public aid under this Code.
12 Any person found guilty of a second or subsequent violation
13 of this Article or of any law of the United States or of any
14 state which is substantially similar to Sections 8A-2 through
15 8A-5 for violations related to public assistance or medical
16 assistance programs of the kind provided under this Code
17 shall be ineligible for public aid under this Code."; and
18 on page 9, by replacing lines 22 through 34 with the
19 following:
20 "(F) The Illinois Department may withhold payments to
21 any vendor during the pendency of any proceeding under this
22 Section except that if a final administrative decision has

1 not been issued within 120 days of the initiation of such
2 proceedings, unless delay has been caused by the vendor,
3 payments can no longer be withheld, provided, however, that
4 the 120 day limit may be extended if said extension is
5 mutually agreed to by the Illinois Department and the vendor.
6 The Illinois Department shall state by rule with as much
7 specificity as practicable the conditions under which
8 payments will not be withheld during the pendency of any
9 proceeding under this Section. Payments may be denied for
10 bills submitted with service dates occurring during the
11 pendency of a proceeding where the final administrative
12 decision is to terminate eligibility to participate in the
13 medical assistance program. The Illinois Department shall
14 state by rule with as much specificity as practicable the
15 conditions under which payments will not be denied for such
16 bills."; and
17 on page 10, by deleting lines 1 through 9; and
18 on page 11, by replacing lines 12 through 30 with the
19 following:
20 "vendor all withheld payments.".
