1 AMENDMENT TO SENATE BILL 1713
2 AMENDMENT NO. . Amend Senate Bill 1713 on page 39,
3 line 15 by deleting "40,"; and
4 on page 41, by deleting lines 28 through 33; and
5 by deleting all of pages 42 and 43; and
6 on page 44, by deleting lines 1 through 22; and
7 on page 47, line 27 by inserting after "services." the
8 following:
9 "Each person committed or detained under this Act who
10 receives services provided directly or funded by the
11 Department and the estate of that person is liable for the
12 payment of sums representing charges for services to the
13 person at a rate to be determined by the Department.
14 Services charges against that person take effect on the date
15 of admission or the effective date of this Section. The
16 Department in its rules may establish a maximum rate for the
17 cost of services. In the case of any person who has received
18 residential services from the Department, whether directly
19 from the Department or through a public or private agency or
20 entity funded by the Department, the liability shall be the
21 same regardless of the source of services. When the person
22 is placed in a facility outside the Department, the facility

1 shall collect reimbursement from the person. The Department
2 may supplement the contribution of the person to private
3 facilities after all other sources of income have been
4 utilized; however the supplement shall not exceed the
5 allowable rate under Title XVIII or Title XIX of the Federal
6 Social Security Act for those persons eligible for those
7 respective programs. The Department may pay the actual costs
8 of services or maintenance in the facility and may collect
9 reimbursement for the entire amount paid from the person or
10 an amount not to exceed the maximum. Lesser or greater
11 amounts may be accepted by the Department when conditions
12 warrant that action or when offered by persons not liable
13 under this Act. Nothing in this Section shall preclude the
14 Department from applying federal benefits that are
15 specifically provided for the care and treatment of a
16 disabled person toward the cost of care provided by a State
17 facility or private agency."; and
18 on page 48, line 15, by inserting after the period the
19 following:
20 "Remittances from intermediary agencies under Title XVIII of
21 the Federal Social Security Act for services to committed
22 persons shall be deposited with the State Treasurer and
23 placed in the Mental Health Fund. Payments received from the
24 Department of Public Aid under Title XIX of the Federal
25 Social Security Act for services to those persons shall be
26 deposited with the State Treasurer and shall be placed in the
27 General Revenue Fund.".
