 1                     AMENDMENT TO HOUSE BILL 41

 2        AMENDMENT NO.     .  Amend House Bill 41, on page  1,  by
 3    inserting between lines 29 and 30 the following:
 4        "(c)  Unavailability  as  a witness under this Section is
 5    limited to the situation in which the declarant is deceased.
 6        (d)  Any prior statement that is sought  to  be  admitted
 7    under this Section must have been made by the declarant under
 8    oath at a trial, hearing, or other proceeding."; and

 9    on page 1, line 30, by changing "(c)" to "(e)".
