1 AN ACT to amend the Criminal Code of 1961 by changing
2 Sections 24.5-5 and 24.5-10.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Criminal Code of 1961 is amended by
6 changing Sections 24.5-5 and 24.5-10 as follows:
7 (720 ILCS 5/24.5-5)
8 Sec. 24.5-5. Unlawful possession. Any person who
9 possesses nitrous oxide or any substance containing nitrous
10 oxide, with the intent to breathe, inhale, or ingest for the
11 purpose of causing a condition of intoxication, elation,
12 euphoria, dizziness, stupefaction, or dulling of the senses
13 or for the purpose of, in any manner, changing, distorting,
14 or disturbing the audio, visual, or mental processes, or who
15 knowingly and with the intent to do so is under the influence
16 of nitrous oxide or any material containing nitrous oxide is
17 guilty of a Class A misdemeanor. A person who commits a
18 second or subsequent violation of this Section is guilty of a
19 Class 4 felony B misdemeanor. This Section shall not apply
20 to any person who is under the influence of nitrous oxide or
21 any material containing nitrous oxide pursuant to an
22 administration for the purpose of medical, surgical, or
23 dental care by a person duly licensed to administer such an
24 agent.

27 Sec. 24.5-10. Unlawful manufacture or delivery sale or
28 distribution.
29 Any person, firm, corporation, co-partnership, limited
30 liability company, or association that intentionally

1 manufactures, delivers, or possesses with intent to
2 manufacture or deliver sells, offers for sale, distributes,
3 or gives away nitrous oxide for any purpose prohibited under
4 Section 24.5-5 is guilty of a Class 3 felony B misdemeanor.
