1 AMENDMENT TO HOUSE BILL 254
2 AMENDMENT NO. . Amend House Bill 254 on page 1, by
3 replacing lines 1 and 2 with the following:
4 "AN ACT concerning hunting and fishing licenses and
5 permits, amending named Acts."; and
6 on page 2, by replacing lines 16 through 29 with the
7 following:
8 "(e) A person whose license or permit to engage in any
9 activity regulated by this Code has been suspended or revoked
10 may not, during the period of the suspension or revocation or
11 until obtaining such a license or permit, (i) be in the
12 company of any person engaging in the activity covered by the
13 suspension or revocation or (ii) serve as a guide, outfitter,
14 or facilitator for a person who is engaged or prepared to
15 engage in the activity covered by the suspension or
16 revocation.
17 (f) No person may be issued or obtain a license or
18 permit or engage in any activity regulated by this Code
19 during the time that the person's privilege to engage in the
20 same or similar activities is suspended or revoked by another
21 state, by a federal agency, or by a province of Canada."; and
22 on page 2, by inserting below line 30 the following:

1 Section 10. The Fish and Aquatic Life Code is amended by
2 changing Section 20-105 as follows:
3 (515 ILCS 5/20-105) (from Ch. 56, par. 20-105)
4 Sec. 20-105. License Revocation and suspension; refusal
5 to issue.
6 (a) Whenever a license or permit is issued to any person
7 under this Code and its holder is found guilty of any
8 misrepresentation in obtaining the license or permit or of a
9 violation of any of the provisions of this Code, including
10 administrative rules, the license or permit may be revoked by
11 the Department and the Department may refuse to issue any
12 permit or license to that person and may suspend the person
13 from engaging in the activity requiring the permit or license
14 for a period of time not to exceed 5 years following the
15 revocation. Department revocation procedure shall be
16 established by administrative rule.
17 (b) Whenever any person who has not been issued a
18 license or a permit under the provisions of this Code is
19 found guilty of a violation of the provisions of this Code,
20 including administrative rules, the Department may refuse to
21 issue any permit or license to that person, and suspend that
22 person from engaging in the activity requiring the permit or
23 license for a period of time not to exceed 5 years.
24 (c) Any person who knowingly or intentionally violates
25 any of the provisions of this Code, including administrative
26 rules, during the 5 years following the revocation of his or
27 her license or permit under subsection (a) or during the time
28 he is suspended under subsection (b), shall be guilty of a
29 Class A misdemeanor as provided in Section 20-35.
30 (d) A person whose license or permit to engage in any
31 activity regulated by this Code has been suspended or revoked
32 may not, during the period of the suspension or revocation or
33 until obtaining such a license or permit, (i) be in the

2 suspension or revocation or (ii) serve as a guide, outfitter,
3 or facilitator for a person who is engaged or prepared to
4 engage in the activity covered by the suspension or

8 during the time that the person's privilege to engage in the

10 state, by a federal agency, or by a province of Canada.
