1 AN ACT concerning point of sale inspections, amending
2 named Acts.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Counties Code is amended by adding
6 Section 3-5020.10 as follows:
7 (55 ILCS 5/3-5020.10 new)
8 Sec. 3-5020.10. Point of sale inspections; certificate
9 of compliance. No recorder may record an instrument
10 conveying title to a dwelling located in an municipality that
11 requires a point of sale inspection under Division 31.2 of
12 Article 11 of the Illinois Municipal Code, unless that
13 instrument is accompanied by a certificate of compliance
14 issued by the municipality.
15 Section 10. The Illinois Municipal Code is amended by
16 adding Division 31.2 to Article 11 as follows:

18 DIVISION 31.2 POINT OF SALE INSPECTIONS

20 Sec. 11-31.2-1. Definition. For the purposes of this
21 Division, "building code" means the same as in Section
22 11-31.1-1 of this Code.

24 Sec. 11-31.2-5. Point of sale inspections. Any
25 municipality may require a point of sale inspection of a
26 dwelling before the dwelling is sold to ensure that the
27 dwelling is in compliance with the municipality's building

1 code. The corporate authorities of a municipality requiring a
2 point of sale inspection may, by ordinance, adopt all
3 regulations necessary to carry out the inspections and may
4 charge a fee for conducting the inspection.

6 Sec. 11-31.2-10. Certificate of compliance.
7 (a) If a municipality requires a point of sale
8 inspection, the municipality must issue a certificate of
9 compliance to the owner of a dwelling that has been inspected
10 and found in compliance with the municipality's building
11 code.
12 (b) No person may convey title to a dwelling in a
13 municipality that requires a point of sale inspection unless
14 that person obtains a certificate of compliance.

16 Sec. 11-31.2-15. Violations of building code. A
17 municipality that conducts of point of sale inspection under
18 this Division may require that violations of the
19 municipality's building code be corrected before a
20 certificate of compliance is issued and the dwelling is sold.

22 Section 99. Effective date. This Act takes effect upon
23 becoming law.
