1 AN ACT concerning real property.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Article 5.
5 Section 5-5. Upon payment of the sum of $1, the Director
6 of Natural Resources, on behalf of the State of Illinois, is
7 authorized to convey by quitclaim deed to the Village of
8 Bartlett all right, title, and interest in and to the
9 following described real property:
10 That part of the Southeast Quarter of Section 36,
11 Township 41 North, Range 8 East of the Third Principal
12 Meridian, described as follows: commencing at the Southeast
13 corner of said Southeast Quarter; thence North 00 degrees 28
14 minutes 15 seconds West, along the East line of said
15 Southeast Quarter, a distance of 1,069.80 feet for the Point
16 of Beginning; thence South 00 degrees 28 minutes 15 seconds
17 East, along said East line, a distance of 933.00 feet; thence
18 South 88 degrees 37 minutes 14 seconds West, parallel with
19 the South line of said Southeast Quarter, a distance of
20 721.09 feet; thence North 00 degrees 28 minutes 15 seconds
21 West, parallel with the aforesaid East line, a distance of
22 565.89 feet; thence South 88 degrees 37 minutes 14 seconds
23 West, parallel with the aforesaid South line, a distance of
24 537.87 feet, to the Easterly right of way line of State Route
25 No. 25 (said right of way line being 33.0 feet Easterly of
26 the centerline); thence Northerly, along said right of way
27 line, being along a Curve to the Left having a Radius of
28 375,747.50 feet and a Chord Bearing of North 02 degrees 41
29 minutes 22 seconds West, an Arc Distance of 367.16 feet, to a
30 line that is parallel with the aforesaid South line and
31 passes through the Point of Beginning; thence North 88

1 degrees 37 minutes 14 seconds East, along said parallel line,
2 a distance of 1273.17 feet to the Point of Beginning, being
3 situated in the Village of Bartlett, Kane County, Illinois,
4 and containing 20.035 acres, more or less.
5 Section 5-10. The conveyance of real property authorized
6 by Section 5-5 shall be made subject to (1) existing public
7 utilities and any and all reservations, easements, covenants,
8 and restrictions of record and (2) the express condition that
9 if said real property ceases to be used for public outdoor
10 recreational purposes, it shall revert to the State of
11 Illinois without further action on the part of the State.
12 Section 5-15. The Director of Natural Resources shall
13 obtain a certified copy of the portions of this Act
14 containing the title, the enacting clause, the effective
15 date, the appropriate Sections containing the land
16 descriptions of property to be transferred, and this Section
17 within 60 days after this Act's effective date and, upon
18 receipt of payment required by the appropriate Sections,
19 shall record the certified document in the Recorder's office
20 in the county in which the land is located.
21 Section 5-20. In consideration of the use of the land by
22 Hardin County for public purposes and without further
23 compensation, the Board of Trustees of the University of
24 Illinois is authorized to convey by quitclaim deed to Hardin
25 County all right, title, and interest in and to the following
26 described land in Hardin County, Illinois:
27 Tract 2
28 Beginning at a point where the East line of the West-half
29 (W 1/2) of the Southeast Quarter (SE 1/4) of Section
30 Fourteen (14), Township Twelve (12) South, Range Eight
31 (8) East of the Third Principal Median intersects the

1 North right-of-way line of Illinois State Highway No. 146
2 (being the Southeast corner of a tract of land conveyed
3 to the University of Illinois by Warranty Deed recorded
4 January 10, 1917 in Deed Book 12, at pages 505-506),
5 thence North a distance of Four Hundred Thirty (430) feet
6 to a point, thence East a distance of Three Hundred
7 Thirty (330) feet to a point, thence South a distance of
8 One Hundred Forty Five and Twenty One Hundredths (145.21)

15 Section 5-25. The Board of Trustees of the University of
16 Illinois shall obtain a certified copy of the portions of
17 this Act containing the title, the enacting clause, the
18 effective date, the appropriate Sections containing the land
19 descriptions of property to be transferred, and this Section
20 within 60 days after this Act's effective date and shall
21 record the certified document in the Recorder's office in the
22 county in which the land is located.
23 Article 7.
24 Section 7-10. Upon the payment of the sum of $1 to the
25 State of Illinois, the Secretary of Human Services is
26 authorized to convey by quitclaim deed to the County of Union
27 all right, title, and interest in and to the following
28 described land in Union County, Illinois, the property to be
29 used for economic development purposes:
30 A PART OF SECTION 14, TOWNSHIP 12 SOUTH, RANGE 2 WEST OF
31 THE THIRD PRINCIPAL MERIDIAN, MORE PARTICULARLY DESCRIBED

16 The conveyance of real property authorized by this
17 Section shall be made subject to the express condition that
18 if that real property ceases to be used for public purposes,
19 it shall revert to the State of Illinois without further

21 Section 7-15. The Secretary of Human Services shall
22 obtain a certified copy of the portions of this Act
23 containing the title, the enacting clause, the effective
24 date, the appropriate Sections containing the land
25 descriptions of property to be transferred, and this Section
26 within 60 days after this Act's effective date and, upon
27 receipt of payment required by the appropriate Sections,
28 shall record the certified document in the Recorder's office
29 in the county in which the land is located.
30 Article 8.
31 Section 8-5. Upon the approval of the Livingston County

1 Board and the payment of the sum of $1 to the State of
2 Illinois, the Director of State Police is authorized to
3 convey by quitclaim deed to the County of Livingston all
4 right, title, and interest in and to a parcel of up to 4
5 acres of the approximately 11 acres on which the Department
6 of State Police District 6 communications facility is located
7 in Pontiac, Livingston County, Illinois. The approximately
8 11 acres, from which the 4-acre parcel shall be conveyed, is
9 described as follows:
10 A part of the Northwest Quarter of Section 27, Township
11 28 North, Range 5 East of the Third Principal Meridian,
12 Livingston County, Illinois, described as follows:
13 Commencing at the Northwest corner of said Section 27,

1 Section 8-10. The conveyance authorized under Section 8-5
2 is subject to the condition that if the property conveyed
3 under that Section is ever not used by the County of
4 Livingston for public purposes, then title to the property
5 shall revert to the State of Illinois without further action
6 on the part of the State.
7 Section 8-15. The Director of State Police shall obtain
8 a certified copy of the portions of this Act containing the
9 title, the enacting clause, the effective date, the
10 appropriate Sections containing the land descriptions of
11 property to be transferred, and this Section within 60 days
12 after this Act's effective date and, upon receipt of payment
13 required by the appropriate Sections, shall record the
14 certified document in the Recorder's office in the county in
15 which the land is located.
16 Article 10.
17 Section 10-1. Short title. This Article may be cited as
18 the Ft. Dearborn United States Army Reserve Center
19 Retrocession Law.
20 Section 10-5. Authorization to accept retrocession.
21 (a) Under the provisions of Section 2683 of Title 10 of
22 the United States Code, the State of Illinois authorizes
23 acceptance of retrocession by the United States of America of
24 exclusive legislative jurisdiction, to the extent such
25 jurisdiction has not previously been retroceded to the State
26 of Illinois, the United States retaining a federal
27 proprietary interest only, over lands consisting of the Ft.
28 Dearborn United States Army Reserve Center, located at O'Hare
29 International Airport in Chicago, Cook County, Illinois, more

11 Further, the State of Illinois accepts retrocession of and
12 authorizes acceptance of retrocession over all those lands
13 owned by the United States that may subsequently be
14 identified by the Department of the Army as part of the Ft.
15 Dearborn United States Army Reserve Center, although not
16 included within the legal description contained in this
17 subsection, to the extent exclusive jurisdiction has not
18 previously been retroceded to the State of Illinois. Any
19 additional land over which the State accepts retrocession of
20 jurisdiction shall be identified in a notice filed by the
21 Governor as provided in subsection (d).
22 (b) By retaining in the subject lands a federal
23 proprietary interest only, there exists a right of the United
24 States to perform the functions delegated to it by the United
25 States Constitution and directed by statutory enactment of
26 the United States Congress without interference from any
27 source. The State of Illinois may not impose its regulatory
28 power directly upon the United States and may not tax the
29 land under the federal proprietary interest; however, the
30 State of Illinois may tax a lessee's interest in the land to
31 the extent State law permits.
32 (c) Subject to subsection (b), the State of Illinois
33 accepts cession of exclusive federal legislative jurisdiction
34 from the United States, and the State of Illinois retains all

1 the legislative jurisdiction over the area it would have if a
2 private individual rather than the United States owned the
3 land.
4 (d) The Governor of the State of Illinois is authorized
5 to accept the retrocession of exclusive legislative
6 jurisdiction over the subject lands by filing a notice of
7 acceptance with the Illinois Secretary of State.
8 (e) Upon transfer by deed of subject lands, or any
9 portion thereof, by the United States of America, the
10 proprietary interest retained by the United States shall
11 expire as to the particular property transferred.
12 ARTICLE 20.
13 Section 20-5. Upon the payment of the sum of $50 to the
14 Department of Natural Resources, the Director of Natural
15 Resources is authorized to convey by quitclaim deed all
16 right, title, and interest in and to the following described
17 real property in Johnson County, Illinois to the Cedar Grove
18 Church, of the Village of Buncombe, County of Johnson, State
19 of Illinois:
20 The South 70.00 feet of the West 50.00 feet of the
21 Southwest Quarter of the Northeast Quarter of Section 31,
22 Township 11 South, Range 2 East of the Third Principal
23 Meridian, Johnson County, Illinois, as said Southwest
24 Quarter of the Northeast Quarter was surveyed by Edward
25 J. Reeder, I.P.L.S. No. 2546, during the months of
26 February through May of 1997.
27 Section 20-10. The Director of Natural Resources shall
28 obtain a certified copy of this Act within 60 days after its
29 effective date and, upon receipt of payment required by this
30 Act, shall record the certified document in the Recorder's
31 Office in the county in which the land is located.

2 Section 30-2. For and in consideration of the sum of $1,
3 the Board of Trustees of Southern Illinois University is
4 authorized to convey, by quitclaim deed executed by the
5 chairperson and attested by the secretary of the Board of
6 Trustees of Southern Illinois University, to the Board of
7 Trustees of Lewis and Clark Community College District No.
8 536 all rights, title, and interest of the Board of Trustees
9 of Southern Illinois University in and to the following
10 described real estate:

12 A parcel of land, known as Lot 8 of the Subdivision
13 of Block 1, Leclaire, as the same appears in Plat Book 6
14 Page 19; (Except coal and other minerals underlying, with
15 right to mine and remove same from thereunder), in

18 A tract of land situated in the Southeast Quarter of
19 Section 11, Township 4 North, Range 8 West of the Third
20 Principal Meridian, within the corporate limits of the
21 City of Edwardsville, Madison County, Illinois; being

23 Northerly portion of Lot 20 of the Subdivision of Block

13 In a proceeding subject to this Section, the plaintiff,
14 at any time after the complaint has been filed and before
15 judgment is entered in the proceeding, may file a written
16 motion requesting that, immediately or at some specified
17 later date, the plaintiff either be vested with the fee
18 simple title (or such lesser estate, interest or easement, as
19 may be required) to the real property, or specified portion
20 thereof, which is the subject of the proceeding, and be
21 authorized to take possession of and use such property; or
22 only be authorized to take possession of and to use such
23 property, if such possession and use, without the vesting of
24 title, are sufficient to permit the plaintiff to proceed with
25 the project until the final ascertainment of compensation;
26 however, no land or interests therein now or hereafter owned,
27 leased, controlled or operated and used by, or necessary for
28 the actual operation of, any common carrier engaged in
29 interstate commerce, or any other public utility subject to
30 the jurisdiction of the Illinois Commerce Commission, shall
31 be taken or appropriated hereunder by the State of Illinois,
32 the Illinois Toll Highway Authority, the sanitary district,
33 the St. Louis Metropolitan Area Airport Authority or the
34 Board of Trustees of the University of Illinois without first

1 securing the approval of such Commission.
2 Except as hereinafter stated, the motion for taking shall
3 state: (1) an accurate description of the property to which
4 the motion relates and the estate or interest sought to be
5 acquired therein; (2) the formally adopted schedule or plan
6 of operation for the execution of the plaintiff's project;
7 (3) the situation of the property to which the motion
8 relates, with respect to the schedule or plan; (4) the
9 necessity for taking such property in the manner requested in
10 the motion; and (5) if the property (except property
11 described in Section 3 of the Sports Stadium Act, or property
12 described as Site B in Section 2 of the Metropolitan Pier and
13 Exposition Authority Act) to be taken is owned, leased,
14 controlled or operated and used by, or necessary for the
15 actual operation of, any interstate common carrier or other
16 public utility subject to the jurisdiction of the Illinois
17 Commerce Commission, a statement to the effect that the
18 approval of such proposed taking has been secured from such
19 Commission, and attaching to such motion a certified copy of
20 the order of such Commission granting such approval. If the
21 schedule or plan of operation is not set forth fully in the
22 motion, a copy of such schedule or plan shall be attached to
23 the motion.
