1 AN ACT to amend the Environmental Barriers Act by
2 changing Section 4.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Environmental Barriers Act is amended by
6 changing Section 4.

8 Sec. 4. Standards. The Capital Development Board shall
9 adopt and publish accessibility standards. Accessibility
10 standards for public facilities shall dictate minimum design,
11 construction and alteration requirements to facilitate access
12 to and use of the public facility by environmentally limited
13 persons. Accessibility standards for multi-story housing
14 units shall dictate minimum design and construction
15 requirements to facilitate access to and use of the common
16 areas by environmentally limited persons and create a number
17 of adaptable dwelling units in accordance with Section 5.
18 With respect to areas within public facilities or multi-story
19 housing units which areas are restricted to use by the
20 employees of businesses or concerns occupying such restricted
21 areas, the Capital Development Board shall promulgate
22 standards designed to ensure that such areas will be
23 accessible to those environmentally limited persons who can
24 reasonably be expected to perform the duties of a job
25 therein.
26 The standards shall be adopted and revised in accordance
27 with The Illinois Administrative Procedure Act.
28 Any accessibility standards regarding an elevator, ramp,
29 or lift promulgated under this Act or rules under this Act
30 shall be no more restrictive than the standards promulgated
31 under the federal Americans with Disabilities Act.

1 The Capital Development Board may issue written
2 interpretation of the standards adopted under Section 4 of
3 this Act. The Capital Development Board shall issue an
4 interpretation within 30 calendar days of receipt of a
5 request by certified mail unless a longer period is agreed to
6 by the parties. Interpretations issued under this Section are
7 project specific and do not constitute precedent for future
8 or different circumstances.
