1 AN ACT in relation to horse racing, amending named Acts.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The State Finance Act is amended by adding
5 Section 5.490 as follows:
6 (30 ILCS 105/5.490 new)
7 Sec. 5.490. The Illinois Racing Quarter Horse Breeders
8 Fund.
9 Section 10. The Illinois Horse Racing Act of 1975 is
10 amended by adding Section 30.5 as follows:
11 (230 ILCS 5/30.5 new)
12 Sec. 30.5. Illinois Quarter Horse Breeders Fund.
13 (a) The General Assembly declares that it is the policy
14 of this State to encourage the breeding of racing quarter
15 horses in this State and the ownership of such horses by
16 residents of this State in order to provide for sufficient
17 numbers of high quality racing quarter horses in this State
18 and to establish and preserve the agricultural and commercial
19 benefits of such breeding and racing industries to the State
20 of Illinois. It is the intent of the General Assembly to
21 further this policy by the provisions of this Act.
22 (b) There is hereby created a special fund in the State
23 Treasury to be known as the Illinois Racing Quarter Horse
24 Breeders Fund. Except as provided in subsection (g) of
25 Section 27 of this Act, 8.5% of all the moneys received by
26 the State as privilege taxes on quarter horse racing shall be
27 paid into the Illinois Racing Quarter Horse Breeders Fund.
28 (c) The Illinois Racing Quarter Horse Breeders Fund
29 shall be administered by the Department of Agriculture with

1 the advice and assistance of the Advisory Board created in
2 subsection (d) of this Section.
3 (d) The Illinois Racing Quarter Horse Breeders Fund
4 Advisory Board shall consist of the Director of the
5 Department of Agriculture, who shall serve as Chairman; a
6 member of the Illinois Racing Board, designated by it; one
7 representative of the organization licensees conducting
8 pari-mutuel quarter horse racing meetings, recommended by
9 them; 2 representatives of the Illinois Running Quarter Horse
10 Association, recommended by it; and the Superintendent of
11 Fairs and Promotions from the Department of Agriculture.
12 Advisory Board members shall serve for 2 years commencing
13 January 1 of each odd numbered year. If representatives have
14 not been recommended by January 1 of each odd numbered year,
15 the Director of the Department of Agriculture may make an
16 appointment for the organization failing to so recommend a
17 member of the Advisory Board. Advisory Board members shall
18 receive no compensation for their services as members but may
19 be reimbursed for all actual and necessary expenses and
20 disbursements incurred in the execution of their official
21 duties.
22 (e) No moneys shall be expended from the Illinois Racing
23 Quarter Horse Breeders Fund except as appropriated by the
24 General Assembly. Moneys appropriated from the Illinois
25 Racing Quarter Horse Breeders Fund shall be expended by the
26 Department of Agriculture, with the advice and assistance of
27 the Illinois Racing Quarter Horse Breeders Fund Advisory
28 Board, for the following purposes only:
29 (1) To provide stakes and awards to be paid to the
30 owners of the winning horses in certain races. This
31 provision is limited to Illinois conceived and foaled
32 horses.
33 (2) To provide an award to the owner or owners of
34 an Illinois conceived and foaled horse that wins a race

1 when pari-mutuel wagering is conducted; providing the
2 race is not restricted to Illinois conceived and foaled
3 horses.
4 (3) To provide purse money for an Illinois stallion
5 stakes program.
6 (4) To provide for purses to be distributed for the
7 running of races during the Illinois State Fair and the
8 DuQuoin State Fair exclusively for quarter horses
9 conceived and foaled in Illinois.
10 (5) To provide for purses to be distributed for the
11 running of races at Illinois county fairs exclusively for
12 quarter horses conceived and foaled in Illinois.
13 (6) To provide for purses to be distributed for
14 running races exclusively for quarter horses conceived
15 and foaled in Illinois at locations in Illinois
16 determined by the Department of Agriculture with advice
17 and consent of the Racing Quarter Horse Breeders Fund
18 Advisory Board.
19 (7) No less than 90% of all moneys appropriated
20 from the Illinois Racing Quarter Horse Breeders Fund
21 shall be expended for the purposes in items (1), (2),
22 (3), (4), and (5) of this subsection (e).
23 (8) To provide for research programs concerning the
24 health, development, and care of racing quarter horses.
25 (9) To provide for dissemination of public
26 information designed to promote the breeding of racing
27 quarter horses in Illinois.
28 (10) To provide for expenses incurred in the
29 administration of the Illinois Racing Quarter Horse
30 Breeders Fund.
31 (f) The Department of Agriculture shall, by rule, with
32 the advice and assistance of the Illinois Racing Quarter
33 Horse Breeders Fund Advisory Board:
34 (1) Qualify stallions for Illinois breeding; such

1 stallions to stand for service within the State of
2 Illinois, at the time of a foal's conception. Such
3 stallion must not stand for service at any place outside
4 the State of Illinois during the calendar year in which
5 the foal is conceived. The Department of Agriculture may
6 assess and collect application fees for the registration
7 of Illinois-eligible stallions. All fees collected are to
8 be paid into the Illinois Racing Quarter Horse Breeders
9 Fund.
10 (2) Provide for the registration of Illinois
11 conceived and foaled horses. No such horse shall compete
12 in the races limited to Illinois conceived and foaled
13 horses unless it is registered with the Department of
14 Agriculture. The Department of Agriculture may prescribe
15 such forms as are necessary to determine the eligibility
16 of such horses. The Department of Agriculture may assess
17 and collect application fees for the registration of
18 Illinois-eligible foals. All fees collected are to be
19 paid into the Illinois Racing Quarter Horse Breeders
20 Fund. No person shall knowingly prepare or cause
21 preparation of an application for registration of such
22 foals that contains false information.
23 (g) The Department of Agriculture, with the advice and
24 assistance of the Illinois Racing Quarter Horse Breeders Fund
25 Advisory Board, shall provide that certain races limited to
26 Illinois conceived and foaled be stakes races and determine
27 the total amount of stakes and awards to be paid to the
28 owners of the winning horses in such races.
