1 AMENDMENT TO HOUSE BILL 1246
2 AMENDMENT NO. . Amend House Bill 1246 by replacing
3 the title with the following:
4 "AN ACT to amend the Illinois Public Aid Code by changing
5 Section 9A-4."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Illinois Public Aid Code is amended by
9 changing Section 9A-4 as follows:
10 (305 ILCS 5/9A-4) (from Ch. 23, par. 9A-4)
11 Sec. 9A-4. Participation.
12 (a) Except for those exempted under subsection (b)
13 below, and to the extent resources permit, the Illinois
14 Department as a condition of eligibility for public aid, may,
15 as provided by rule, require all recipients to participate in
16 an education, training, and employment program, which shall
17 include accepting suitable employment and refraining from
18 terminating employment or reducing earnings without good
19 cause.
20 (b) A recipient Recipients shall be exempt from the
21 requirement of participation in the education, training, and

1 employment program if he or she is determined by the
2 Department to be exempt because he or she is:
3 (1) a person who is ill, incapacitated, or 60 years
4 of age or older;
5 (2) a child who is under 16 years of age or under
6 the age of 19 and attending a secondary, vocational, or
7 technical school full-time;
8 (3) a person whose presence in the home is required
9 because of the illness or incapacity of another member of
10 the household, provided that, to the extent the person is
11 providing care for another member of the household for
12 the number of hours required in subsection (n) of Section
13 9A-9, that person shall be deemed to be participating in
14 community service;
15 (4) a parent or other relative of a child under one
16 year of age who is personally providing care for the
17 child for a maximum period of 12 months;
18 (5) a woman who is pregnant, beginning 30 days
19 prior to the medically verified date of delivery of her
20 child. in the following circumstances:
21 (1) The recipient is a person over age 60; or
22 (2) The recipient is a person with a child under
23 age one.

25 Section 99. Effective date. This Act takes effect upon
26 becoming law.".
