1 AN ACT to amend the Civil Administrative Code of Illinois
2 by adding Section 46.19k.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Civil Administrative Code of Illinois is
6 amended by adding Section 46.19k as follows:
7 (20 ILCS 605/46.19k new)
8 Sec. 46.19k. Family loan program.
9 (a) From amounts appropriated for such purpose, the
10 Department in consultation with the Department of Human
11 Services shall solicit proposals to establish programs to be
12 known as family loan programs. Such programs shall provide
13 small, no-interest loans to custodial parents with income
14 below 200% of the federal poverty level and who are working
15 or enrolled in a post-secondary education program, to aid in
16 covering the costs of unexpected expenses that could
17 interfere with their ability to maintain employment or
18 continue education. Loans awarded through a family loan
19 program may be paid directly to a third party on behalf of a
20 loan recipient and in either case shall not constitute income
21 or resources for the purposes of public assistance and care
22 so long as the funds are used for the intended purpose.
23 (b) The Director shall enter into written agreements with
24 not-for-profit organizations or local government agencies to
25 administer loan pools. Agreements shall be entered into with
26 no more than 4 organizations or agencies, no more than one of
27 which shall be located in the city of Chicago.
28 (c) Program sites shall be approved based on the
29 demonstrated ability of the organization or governmental
30 agency to secure funding from private or public sources
31 sufficient to establish a loan pool to be maintained through

1 repayment agreements entered into by eligible low-income
2 families. Funds awarded by the Department to approved
3 program sites shall be used for the express purposes of
4 covering staffing and administration costs associated with
5 administering the loan pool.
