1 AN ACT to amend the Illinois Vehicle Code by changing
2 Section 7-601.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Vehicle Code is amended by
6 changing Section 7-601 as follows:
7 (625 ILCS 5/7-601) (from Ch. 95 1/2, par. 7-601)
8 Sec. 7-601. Required liability insurance policy.
9 (a) No person shall operate, register or maintain
10 registration of, and no owner shall permit another person to
11 operate, register or maintain registration of, a motor
12 vehicle designed to be used on a public highway unless the
13 motor vehicle is covered by a liability insurance policy.
14 The insurance policy shall be issued in amounts no less
15 than the minimum amounts set for bodily injury or death and
16 for destruction of property under Section 7-203 of this Code,
17 and shall be issued in accordance with the requirements of
18 Sections 143a and 143a-2 of the Illinois Insurance Code, as
19 amended. No insurer other than an insurer authorized to do
20 business in this State shall issue a policy pursuant to this
21 Section for any vehicle subject to registration under this
22 Code. Nothing herein shall deprive an insurer of any policy
23 defense available at common law.
24 (b) The following vehicles are exempt from the
25 requirements of this Section:
26 (1) vehicles subject to the provisions of Chapters
27 8 or 18a, Article III or Section 7-609 of Chapter 7, or
28 Sections 12-606 or 12-707.01 of Chapter 12 of this Code;
29 (2) vehicles required to file proof of liability
30 insurance with the Illinois Commerce Commission;
31 (3) vehicles covered by a certificate of

1 self-insurance under Section 7-502 of this Code;
2 (4) vehicles owned by the United States, the State
3 of Illinois, or any political subdivision, municipality
4 or local mass transit district;
5 (5) implements of husbandry;
6 (6) other vehicles complying with laws which
7 require them to be insured in amounts meeting or
8 exceeding the minimum amounts required under this
9 Section; and
10 (7) inoperable or stored vehicles that are not
11 operated, as defined by rules and regulations of the
12 Secretary.
13 (c) Every employee of a State agency, as that term
14 is defined in the Illinois State Auditing Act, who is
15 assigned a specific vehicle owned or leased by the State
16 on an ongoing basis shall provide the certification
17 described in this Section annually to the director or
18 chief executive officer of his or her agency.
19 The certification shall affirm that the employee is
20 duly licensed to drive the assigned vehicle and that (i)
21 the employee has a non-owned vehicle liability
22 endorsement in the form of insurance, or (ii) the
23 employee has filed a bond with the Secretary of State as
24 proof of financial responsibility, in an amount equal to,
25 or in excess of the requirements stated within this
26 Section. Upon request of the agency director or chief
27 executive officer, the employee shall present evidence to
28 support the certification.
29 The certification shall be provided during the
30 period July 1 through July 31 of each calendar year, or
31 within 30 days of any new assignment of a vehicle on an
32 ongoing basis, whichever is later.
33 The employee's authorization to use the assigned
34 vehicle shall automatically be rescinded upon:

1 (1) the revocation or suspension of the
2 license required to drive the assigned vehicle;
3 (2) the cancellation or termination for any
4 reason of the non-owned vehicle liability
5 endorsement; or
6 (3) the termination of the bond filed with the
7 Secretary of State.
8 All State employees providing the required
9 certification shall immediately notify the agency
10 director or chief executive officer in the event any of
11 these actions occur.

13 Section 99. Effective date. This Act takes effect on
14 July 1, 1999.
