1 AN ACT to amend the Illinois Educational Labor Relations
2 Act by changing Section 1.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Educational Labor Relations Act
6 is amended by changing Section 1 as follows:
7 (115 ILCS 5/1) (from Ch. 48, par. 1701)
8 Sec. 1. Policy. It is The public policy of this State
9 and the purpose of this Act is to promote orderly and
10 constructive relationships between all educational employees
11 and their employers. Unresolved disputes between the
12 educational employees and their employers are injurious to
13 the public, and the General Assembly is therefore aware that
14 adequate means must be established for minimizing them and
15 providing for their resolution. It is the purpose of this Act
16 to regulate labor relations between educational employers and
17 educational employees, including the designation of
18 educational employee representatives, negotiation of wages,
19 hours and other conditions of employment and resolution of
20 disputes arising under collective bargaining agreements. The
21 General Assembly recognizes that substantial differences
22 exist between educational employees and other public
23 employees as a result of the uniqueness of the educational
24 work calendar and educational work duties and the traditional
25 and historical patterns of collective bargaining between
26 educational employers and educational employees and that such
27 differences demand statutory regulation of collective
28 bargaining between educational employers and educational
29 employees in a manner that recognizes these differences.
30 Recognizing that harmonious relationships are required
31 between educational employees and their employers, the

1 General Assembly has determined that the overall policy may
2 best be accomplished by (a) granting to educational employees
3 the right to organize and choose freely their
4 representatives; (b) requiring educational employers to
5 negotiate and bargain with employee organizations
6 representing educational employees and to enter into written
7 agreements evidencing the result of such bargaining; and (c)
8 establishing procedures to provide for the protection of the
9 rights of the educational employee, the educational employer
10 and the public.
