1 AN ACT to amend the Illinois Prepaid Tuition Act by
2 changing Section 10.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Prepaid Tuition Act is amended
6 by changing Section 10 as follows:

8 Sec. 10. Definitions. In this Act:
9 "Illinois public university" means the University of
10 Illinois, Illinois State University, Chicago State
11 University, Governors State University, Southern Illinois
12 University, Northern Illinois University, Eastern Illinois
13 University, Western Illinois University, or Northeastern
14 Illinois University.
15 "Illinois community college" means a public community
16 college as defined in Section 1-2 of the Public Community
17 College Act.
18 "MAP-eligible institution" means a public institution of
19 higher education or a nonpublic institution of higher
20 education whose students are eligible to receive need-based
21 student financial assistance through State Monetary Award
22 Program (MAP) grants administered by the Illinois Student
23 Assistance Commission under the Higher Education Student
24 Assistance Act and whose students also are eligible to
25 receive benefits under Section 529(a) of the Internal Revenue
26 Code of 1986, as specified by the federal Small Business Act
27 of 1996 and subsequent amendments to this federal law.
28 "Illinois prepaid tuition contract" or "contract" means a
29 contract entered into between the State and a Purchaser under
30 Section 45 to provide for the higher education of a qualified
31 beneficiary.

1 "Illinois prepaid tuition program" or "program" means the
2 program created in Section 15.
3 "Purchaser" means a person who makes or has contracted to
4 make payments under an Illinois prepaid tuition contract.
5 "Public institution of higher education" means an
6 Illinois public university or Illinois community college.
7 "Nonpublic institution of higher education" means any
8 MAP-eligible educational organization, other than a public
9 institution of higher education, that provides a minimum of
10 an organized 2-year program at the postsecondary level and
11 that operates in conformity with standards substantially
12 equivalent to those of public institutions of higher
13 education. "Nonpublic institution of higher education" does
14 not include any educational organization used principally for
15 sectarian instruction, as a place of religious teaching or
16 worship, or for any religious denomination for the training
17 of ministers, rabbis, or other professional persons in the
18 field of religion.
19 "Qualified beneficiary" means (i) anyone who has been a
20 resident of this State for at least 12 months prior to the
21 date of the contract, or (ii) a nonresident, so long as the
22 purchaser has been a resident of the State for at least 12
23 months prior to the date of the contract, or (iii) any person
24 less than one year of age who is a relative of an Illinois
25 resident, or (iv) a nonresident, if his or her parents are
26 divorced and have joint custody, so long as one parent is an
27 Illinois resident.
28 "Tuition" means the quarter or semester charges imposed
29 on a qualified beneficiary to attend a MAP-eligible
30 institution.
31 "Mandatory Fees" means those quarter or semester fees
32 imposed upon all students enrolled at a MAP-eligible
33 institution.
34 "Registration Fees" means the charges derived by

1 combining tuition and mandatory fees.
2 "Contract Unit" means 15 credit hours of instruction at a
3 MAP-eligible institution.
4 "Panel" means the advisory panel created under Section
5 20.
6 "Commission" means the Illinois Student Assistance
7 Commission.

9 Section 99. Effective date. This Act takes effect July
10 1, 1999.
