1 AMENDMENT TO HOUSE BILL 1959
2 AMENDMENT NO. . Amend House Bill 1959 on page 1,
3 line 11 by replacing "contracts with or" with the following:
4 "enters into reimbursement agreements with, contracts with,
5 and"; and
6 on page 1, line 21 by replacing "contracts" with the
7 following:
8 "reimbursement agreements, contracts,"; and
9 on page 2, line 21 by inserting "reimbursement agreement or"
10 after "has a"; and
11 on page 2, line 25 by replacing "contract" with the
12 following:
13 "reimbursement agreement, contract,"; and
14 on page 2, line 29 by replacing "grantee." with the
15 following:
16 "grantee and any other entity controlled in whole or in part
17 by the contractor, or an entity in which the contractor has a
18 substantial beneficial interest, or an entity which
19 contributes money, goods, or services to the contractor.";
20 and
21 on page 2, line 30 by inserting after "contractor" the

2 "and any other entity controlled in whole or in part by the
3 grantee, or an entity in which the grantee has a substantial
4 beneficial interest, or an entity which contributes money,
5 goods, or services to the grantee"; and
6 on page 3, by replacing lines 8 through 18 with the
7 following:
8 "or a grantee which includes all of the following provisions:
9 (i) not to use State funds, directly or indirectly,
10 to promote, assist, or to deter union organizing or to
11 otherwise seek to influence the decision of any of its
12 employees to be represented or not represented by a labor
13 organization; and
14 (ii) not to require or prohibit the attendance of
15 employees at any meeting related to union representation;
16 and
17 (iii) not to schedule or hold meetings related to
18 union representation during an employee's work time or in
19 work areas; and
20 (iv) to allow a labor organization the same
21 opportunity to communicate with employees as is used by
22 the contractor or the grantee, including the right to
23 have access to the premises of the contractor or grantee,
24 post notices, distribute literature, and use the premises
25 of the employer to hold meetings with employees.
26 "State funds" means any money or other thing of value
27 provided directly or indirectly by the State of Illinois, a
28 State agency, or a political subdivision of the State of
29 Illinois."; and
30 on page 3, line 27 by replacing "contract" with the
31 following:
32 "reimbursement agreement, contract, or grant"; and
33 on page 3, line 28 by inserting after "contractor" the

2 "or a grantee"; and
3 on page 3, line 31 by inserting after "contractor" the
4 following:
5 "or grantee"; and
6 on page 4, by inserting after line 13 the following:
7 "Section 20. Reporting. Any labor organization may file
8 a complaint with the Department of Human Services if it
9 believes that a contractor or grantee is expending funds in
10 violation of this Act. Upon the filing of such a complaint,
11 the Department of Human Services shall, within one week,
12 notify the contractor or grantee that it must provide the
13 following accounting:
14 (a) the date, the amount of, and the nature of any use
15 of money or other things of value for the production or
16 distribution of literature or other similar communications,
17 the holding of meetings, including meetings with supervisors
18 and managerial employees, and the use of consultants or
19 lawyers;
20 (b) the source of the money or other things of value so
21 used.
22 The accounting shall be made to the Department of Human
23 Services within 14 calendar days of the receipt of the
24 request for it. The accounting shall be made available to
25 the complainant upon receipt by the Department of Human
26 Services."; and
27 on page 4, line 14 by changing "20" to "25"; and
28 on page 4, line 16 by inserting after "agreement" the
29 following:
30 "or fails to comply with the reporting requirements of
31 Section 20".
