1 AMENDMENT TO HOUSE BILL 2103
2 AMENDMENT NO. . Amend House Bill 2103 on page 1, by
3 inserting between lines 4 and 5 the following:
4 "Section 2. The Housing Authorities Act is amended by
5 adding Section 8.23 as follows:
6 (310 ILCS 10/8.23 new)
7 Sec. 8.23. Notification to leaseholders of the
8 prospective presence of felons in housing authority
9 facilities; eviction.
10 (a) Immediately upon the receipt of the written
11 notification, from the Department of Corrections under
12 subsection (c) of Section 3-14-1 of the Unified Code of
13 Corrections, that a felon intends to reside, upon release
14 from custody, at an address that is a housing facility owned,
15 managed, operated, or leased by the Authority, the Authority
16 must provide written notification to the leaseholder residing
17 at that address.
18 (b) The Authority may not evict the leaseholder
19 described in subsection (a) of this Section unless the
20 Authority proves by a preponderance of the evidence that the
21 leaseholder had knowledge of and consents to the felon's
22 intent to reside at the leaseholder's address."; and
