1 AN ACT to amend the Alcoholism and Other Drug Abuse and
2 Dependency Act by changing Section 10-15.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Alcoholism and Other Drug Abuse and
6 Dependency Act is amended by changing Section 10-15 as
7 follows:
8 (20 ILCS 301/10-15)
9 Sec. 10-15. Qualification and appointment of members.
10 The membership of the Illinois Advisory Council shall consist
11 of:
12 (a) a State's Attorney designated by the President
13 of the Illinois State's Attorneys Association.
14 (b) a judge designated by the Chief Justice of the
15 Illinois Supreme Court.
16 (c) a Public Defender appointed by the President of
17 the Illinois Public Defenders Association.
18 (d) a local law enforcement officer appointed by
19 the Governor.
20 (e) a labor representative appointed by the
21 Governor.
22 (f) an educator appointed by the Governor.
23 (g) a physician licensed to practice medicine in
24 all its branches appointed by the Governor with due
25 regard for the appointee's knowledge of the field of
26 alcoholism and other drug abuse and dependency.
27 (h) 4 members of the Illinois House of
28 Representatives, 2 each appointed by the Speaker and
29 Minority Leader.
30 (i) 4 members of the Illinois Senate, 2 each
31 appointed by the President and Minority Leader.

1 (j) the President of the Illinois Alcoholism and
2 Drug Dependence Association.
3 (k) an advocate for the needs of youth appointed by
4 the Governor.
5 (l) the President of the Illinois State Medical
6 Society or his or her designee.
7 (m) the President of the Illinois Hospital
8 Association or his or her designee.
9 (n) the President of the Illinois Nurses
10 Association or a registered nurse designated by the
11 President.
12 (o) the President of the Illinois Pharmacists
13 Association or a licensed pharmacist designated by the
14 President.
15 (p) the President of the Illinois Chapter of the
16 Association of Labor Management Administrators and
17 Consultants on Alcoholism.
18 (p-1) the President of the Community Behavioral
19 Healthcare Association of Illinois or his or her
20 designee.
21 (q) the Attorney General or his or her designee.
22 (r) the State Comptroller or his or her designee.
23 (s) 20 public members, 8 appointed by the Governor,
24 3 of whom shall be representatives of alcoholism or other
25 drug abuse and dependency treatment programs and one of
26 whom shall be a representative of a manufacturer or
27 importing distributor of alcoholic liquor licensed by the
28 State of Illinois, and 3 public members appointed by each
29 of the President and Minority Leader of the Senate and
30 the Speaker and Minority Leader of the House.
31 The public members may not be officers or employees of
32 the executive branch of State government; however, the public
33 members may be officers or employees of a State college or
34 university or of any law enforcement agency. In appointing

1 members, due consideration shall be given to the experience
2 of appointees in the fields of medicine, law, prevention,
3 correctional activities, and social welfare. Vacancies in
4 the public membership shall be filled for the unexpired term
5 by appointment in like manner as for original appointments,
6 and the appointive members shall serve until their successors
7 are appointed and have qualified. Vacancies among the public
8 members appointed by the legislative leaders shall be filled
9 by the leader of the same house and of the same political
10 party as the leader who originally appointed the member.
11 Each non-appointive member may designate a representative
12 to serve in his place by written notice to the Department.
13 All General Assembly members shall serve until their
14 respective successors are appointed or until termination of
15 their legislative service, whichever occurs first. The terms
16 of office for each of the members appointed by the Governor
17 shall be for 3 years, except that of the members first
18 appointed, 3 shall be appointed for a term of one year, and 4
19 shall be appointed for a term of 2 years. The terms of
20 office of each of the public members appointed by the
21 legislative leaders shall be for 2 years.

23 Section 99. Effective date. This Act takes effect upon
24 becoming law.
