1 AN ACT in relation to criminal law.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Criminal Code of 1961 is amended by
5 changing Section 10-1 as follows:
6 (720 ILCS 5/10-1) (from Ch. 38, par. 10-1)
7 Sec. 10-1. Kidnapping.) (a) Kidnapping occurs when a
8 person knowingly:
9 (1) And secretly confines another against his or her
10 will, or
11 (2) By force or threat of imminent force carries another
12 from one place to another with intent secretly to confine him
13 or her against his or her will, or
14 (3) By deceit or enticement induces another to go from
15 one place to another with intent secretly to confine him or
16 her against his or her will.
17 (b) Confinement of a child under the age of 13 years is
18 against his or her will within the meaning of this Section if
19 such confinement is without the consent of his or her parent
20 or legal guardian.
21 (c) Sentence.
22 Kidnapping is a Class 2 felony.

24 Section 10. The Code of Criminal Procedure of 1963 is
25 amended by changing Section 101-1 as follows:
26 (725 ILCS 5/101-1) (from Ch. 38, par. 101-1)
27 Sec. 101-1. General purposes.
28 The provisions of this Code shall be construed in
29 accordance with the following general purposes hereof, to:

1 (a) Secure simplicity in procedure;
2 (b) Ensure fairness of administration including the
3 elimination of unjustifiable delay;
4 (c) Ensure the effective apprehension and trial of
5 persons accused of crime;
6 (d) Provide for the just determination of every criminal
7 proceeding by a fair and impartial trial and an adequate
8 review; and
9 (e) Preserve the public welfare and secure the
10 fundamental human rights of individuals.
