1 AN ACT concerning window guards in high-rise residential
2 buildings.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 1. Short title. This Act may be cited as the
6 High-rise Residential Building Window Guard Act.
7 Section 5. Public policy. The General Assembly finds
8 that the public health and safety, and in particular the
9 health and safety of children residing in high-rise
10 buildings, require the installation of window guards on
11 windows in high-rise residential buildings.
12 Section 10. Definition. In this Act, "Department" means
13 the Department of Public Health.
14 Section 15. Window guards required. The owner or lessee
15 of a high-rise residential building, or the owner's or
16 lessee's agent, or any other person who manages or controls a
17 high-rise residential building, must install window guards on
18 the windows of the building in a manner approved by the
19 Department.
20 Section 20. Violation; penalty. A person who knowingly
21 fails to install window guards as required in Section 15 or
22 the rules implementing this Act commits a Class B
23 misdemeanor.
24 Section 25. Enforcement. The Department shall enforce
25 this Act.
26 Section 30. Rules. The Department shall adopt rules

1 necessary to administer and enforce this Act. The rules
2 shall include a definition of the buildings to which this Act
3 applies and standards for the design and installation of
4 window guards.
5 Section 35. Home rule. A home rule unit may not regulate
6 the installation of window guards on high-rise residential
7 buildings in a manner less restrictive than the regulation by
8 the State of the installation of window guards on high-rise
9 residential buildings under this Act. This Section is a
10 limitation under subsection (i) of Section 6 of Article VII
11 of the Illinois Constitution on the concurrent exercise by
12 home rule units of powers and functions exercised by the
13 State.
