1 AN ACT to amend the Counties Code by changing Section
2 5-25012.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Counties Code is amended by changing
6 Sections 5-25012 as follows:

8 Sec. 5-25012. Board of health. Except in those cases
9 where a board of 12 members is provided for as authorized in
10 this Section, each county health department shall be managed
11 by a board of health consisting of 9 8 members appointed by
12 the president or chairman of the county board, with the
13 approval of the county board, for a 3 year term, except that
14 of the first appointees 2 shall serve for one year, 2 for 2
15 years, 3 for 3 years and the term of the member appointed
16 from the county board, as provided in this Section, shall be
17 one year and shall continue until reappointment or until a
18 successor is appointed. The additional member added by this
19 amendatory Act of the 91st General Assembly shall first be
20 appointed within 90 days after the effective date of this
21 amendatory Act for a term ending July 1, 2002.
22 The county health department in a county having a
23 population of 200,000 or more may, if the county board, by
24 resolution, so provides, be managed by a board of health
25 consisting of 12 members appointed by the president or
26 chairman of the county board, with the approval of the county
27 board, for a 3 year term, except that of the first appointees
28 3 shall serve for one year, 4 for 2 years, 4 for 3 years and
29 the term of the member appointed from the county board, as
30 provided in this Section, shall be one year and shall
31 continue until reappointment or until a successor is

1 appointed. In counties with a population of 200,000 or more
2 which have a board of health of 8 members, the county board
3 may, by resolution, increase the size of the board of health
4 to 12 members, in which case the 4 members added shall be
5 appointed, as of the next anniversary of the present
6 appointments, 2 for terms of 3 years, one for 2 years and one
7 for one year.
8 The county board in counties with a population of more
9 than 100,000 but less than 3,000,000 inhabitants and
10 contiguous to any county with a metropolitan area with more
11 than 1,000,000 inhabitants, may establish compensation for
12 the board of health, as remuneration for their services as
13 members of the board of health. Monthly compensation shall
14 not exceed $200 except in the case of the president of the
15 board of health whose monthly compensation shall not exceed
16 $400.
17 Each multiple-county health department shall be managed
18 by a board of health consisting of 4 members appointed from
19 each county by the president or chairman of the county board
20 with the approval of the county board for a 3 year term,
21 except that of the first appointees from each county one
22 shall serve for one year, one for 2 years, one for 3 years
23 and the term of the member appointed from the county board of
24 each member county, as hereinafter provided, shall be one
25 year and shall continue until reappointment or until a
26 successor is appointed.
27 The term of office of original appointees shall begin on
28 July 1 following their appointment, and the term of all
29 members shall continue until their successors are appointed.
30 All members shall serve without compensation but may be
31 reimbursed for actual necessary expenses incurred in the
32 performance of their duties. At least 2 members of each
33 county board of health shall be physicians licensed in
34 Illinois to practice medicine in all of its branches and at

1 least one member shall be a dentist licensed in Illinois. In
2 counties with a population under 500,000, one member shall be
3 chosen from the county board or the board of county
4 commissioners as the case may be. In counties with a
5 population over 500,000, two members shall be chosen from the
6 county board or the board of county commissioners as the case
7 may be. At least one member from each county on each
8 multiple-county board of health shall be a physician licensed
9 in Illinois to practice medicine in all of its branches, one
10 member from each county on each multiple-county board of
11 health shall be chosen from the county board or the board of
12 county commissioners, as the case may be, and at least one
13 member of the board of health shall be a dentist licensed in
14 Illinois. Whenever possible, at least one member shall have
15 experience in the field of mental health. All members shall
16 be chosen for their special fitness for membership on the
17 board.
18 Any member may be removed for misconduct or neglect of
19 duty by the chairman or president of the county board, with
20 the approval of the county board, of the county which
21 appointed him.
22 Vacancies shall be filled as in the case of appointment
23 for a full term.
24 Notwithstanding any other provision of this Act to the
25 contrary, a county with a population of 240,000 or more
26 inhabitants that does not currently have a county health
27 department may, by resolution of the county board, establish
28 a board of health consisting of the members of such board.
29 Such board of health shall be advised by a committee which
30 shall consist of at least 5 members appointed by the
31 president or chairman of the county board with the approval
32 of the county board for terms of 3 years; except that of the
33 first appointees at least 2 shall serve for 3 years, at least
34 2 shall serve for 2 years and at least one shall serve for

1 one year. At least one member of the advisory committee
2 shall be a physician licensed in Illinois to practice
3 medicine in all its branches, at least one shall be a dentist
4 licensed in Illinois, and one shall be a nurse licensed in
5 Illinois. All members shall be chosen for their special
6 fitness for membership on the advisory committee.

8 Section 99. Effective date. This Act takes effect upon
