1 AN ACT to amend the Mental Health and Developmental
2 Disabilities Code by adding Sections 3-911 and 4-710.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Mental Health and Developmental
6 Disabilities Code is amended by adding Sections 3-911 and
7 4-710 as follows:
8 (405 ILCS 5/3-911 new)
9 Sec. 3-911. Transfer by Guardianship and Advocacy
10 Commission. Before the Guardianship and Advocacy Commission
11 may transfer a recipient to another Department facility, the
12 Commission must listen to the recommendation of the facility
13 director of the facility where the recipient is receiving
14 treatment or habilitation. If the Commission and the
15 facility director disagree over the matter of the transfer of
16 a recipient, they shall submit the matter to an arbitration
17 body, which shall decide the matter. The body shall consist
18 of all of the following members: (1) the Director of Human
19 Services or his or her designee, (2) the Director of Public
20 Health or his or her designee, and (3) in cases where the
21 recipient is 55 years of age or older, the Director of the
22 Department on Aging.
