1 AMENDMENT TO HOUSE BILL 2884
2 AMENDMENT NO. . Amend House Bill 2884, AS AMENDED,
3 in the title, by deleting ", amending certain named Acts";
4 and
5 by replacing everything after the enacting clause with the
6 following:
7 "Section 5. The Bingo License and Tax Act is amended by
8 changing Section 2 as follows:
9 (230 ILCS 25/2) (from Ch. 120, par. 1102)
10 Sec. 2. The conducting of bingo is subject to the
11 following restrictions:
12 (1) The entire net proceeds from bingo play must be
13 exclusively devoted to the lawful purposes of the
14 organization permitted to conduct that game.
15 (2) (Blank). No person except a bona fide member of the
16 sponsoring organization or a bona fide member of an auxiliary
17 organization, substantially all of whose members are spouses
18 of members of the sponsoring organization may participate in
19 the management or operation of the game.
20 (3) No person may receive any remuneration or profit for
21 participating in the management or operation of the game,

1 except that if an organization licensed under this Act is
2 associated with a school or other educational institution,
3 that school or institution may reduce tuition or fees for a
4 designated pupil based on participation in the management or
5 operation of the game by any member of the organization. The
6 extent to which tuition and fees are reduced shall relate
7 proportionately to the amount of time volunteered by the
8 member, as determined by the school or other educational
9 institution.
10 (4) The aggregate retail value of all prizes or
11 merchandise awarded in any single day of bingo may not exceed
12 $2,250, except that in adjoining counties having 200,000 to
13 275,000 inhabitants each, and in counties which are adjacent
14 to either of such adjoining counties and are adjacent to a
15 total of not more than 2 counties in this State, and in any
16 municipality having 2,500 or more inhabitants and within one
17 mile of such adjoining and adjacent counties having less than
18 25,000 inhabitants, 2 additional bingo games may be conducted
19 after the $2,250 limit has been reached. The prize awarded
20 for any one game, including any game conducted after reaching
21 the $2,250 limit as authorized in this paragraph (4), may not
22 exceed $500 cash or its equivalent.
23 (5) The number of games may not exceed 25 in any one day
24 including regular and special games, except that this
25 restriction on the number of games shall not apply to bingo
26 conducted at the Illinois State Fair or any county fair held
27 in Illinois.
28 (6) The price paid for a single card under the license
29 may not exceed $1 and such card is valid for all regular
30 games on that day of bingo. A maximum of 5 special games may
31 be held on each bingo day, except that this restriction on
32 the number of special games shall not apply to bingo
33 conducted at the Illinois State Fair or any county fair held
34 in Illinois. The price for a single special game card may not

1 exceed 50 cents.
2 (7) The number of bingo days conducted by a licensee
3 under this Act is limited to one per week, except as follows:
4 (i) Bingo may be conducted in accordance with the
5 terms of a special operator's permit or limited license
6 issued under subdivision (3) of Section 1.
7 (ii) Bingo may be conducted at the Illinois State
8 Fair or any county fair held in Illinois under
9 subdivision (3) of Section 1.
10 (iii) A licensee which cancels a day of bingo
11 because of inclement weather or because the day is a
12 holiday or the eve of a holiday may, after giving notice
13 to the Department, conduct bingo on an additional date
14 which falls on a day of the week other than the day
15 authorized under the license. As used in this
16 subdivision (iii), "holiday" means any of the holidays
17 listed in Section 17 of the Promissory Note and Bank
18 Holiday Act.
19 (8) A licensee may rent a premises on which to conduct
20 bingo only from an organization which is licensed as a
21 provider of premises or exempt from license requirements
22 under this Act. If the organization providing the premises is
23 a metropolitan exposition, auditorium, and office building
24 authority created by State law, a licensee may enter into a
25 rental agreement with the organization authorizing the
26 licensee and the organization to share the gross proceeds of
27 bingo games; however, the organization shall not receive more
28 than 50% of the gross proceeds.
29 (9) No person under the age of 18 years may play or
30 participate in the conducting of bingo. Any person under the
31 age of 18 years may be within the area where bingo is being
32 played only when accompanied by his parent or guardian.
33 (10) The promoter of bingo games must have a proprietary
34 interest in the game promoted.

1 (11) Raffles or other forms of gambling prohibited by
2 law shall not be conducted on the premises where bingo is
3 being conducted, except that pull tabs and jar games
4 conducted under the Illinois Pull Tabs and Jar Games Act may
5 be conducted on the premises where bingo is being conducted.
6 Prizes awarded in pull tabs and jar games shall not be
7 included in the bingo prize limitation.
8 (12) An organization holding a special operator's permit
9 or a limited license may, as one of the occasions allowed by
10 such permit or license, conduct bingo for a maximum of 2
11 consecutive days, during each day of which the number of
12 games may exceed 25, and regular game cards need not be valid
13 for all regular games. If only noncash prizes are awarded
14 during such occasions, the prize limits stated in paragraph
15 (4) of this Section shall not apply, provided that the retail
16 value of noncash prizes for any single game shall not exceed
17 $150.
