1 AN ACT to amend the Public Utilities Act by changing
2 Section 16-109.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Public Utilities Act is amended by
6 changing Section 16-109 as follows:

8 Sec. 16-109. Unbundling of delivery services; periodic
9 Commission review. The General Assembly finds that the
10 offering of delivery services will, and is intended to,
11 facilitate the development of competition for generation
12 services, and that competition may develop for other services
13 currently offered on a tariffed basis by the electric
14 utility. The Commission shall open a proceeding to
15 investigate the need for and desirability of different or
16 additional unbundling of delivery services for some or all
17 electric utilities 3 years from the date that a tariff for
18 delivery services is first approved or allowed into effect
19 pursuant to this Section. The Commission shall open an
20 additional proceeding to again investigate the need for and
21 desirability of different or additional unbundling of
22 delivery services for some or all electric utilities, 3 years
23 after the entry of its final order in the first investigation
24 proceeding. The Commission shall issue its final order in
25 each investigation proceeding no later than 6 months after
26 the proceeding is initiated. In each such proceeding the
27 Commission shall consider, at a minimum, the effect of
28 additional unbundling on (i) the objective of just and
29 reasonable rates, (ii) electric utility employees, and (iii)
30 the development of competitive markets for electric energy
31 services in Illinois. Specific changes to the delivery

1 services tariffs of individual electric utilities to
2 implement findings and directives stated in an order in an
3 investigation proceeding initiated under this Section shall
4 be addressed through individual electric utility tariff
5 filings. The Commission may also, in accordance with Section
6 16-108, upon complaint or upon its own initiative without
7 complaint, upon reasonable notice, enter upon a hearing
8 concerning the need and desirability of requiring additional
9 or other unbundling of delivery services offered by electric
10 utilities.
