1 AN ACT concerning blighted areas redevelopment.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Blighted Areas Redevelopment Act of 1947
5 is amended by changing Section 4 as follows:
6 (315 ILCS 5/4) (from Ch. 67 1/2, par. 66)
7 Sec. 4. Resolution determining need for Commission in
8 municipality or county. Excepting any municipality for and
9 in which there exists a Department of Urban Renewal created
10 pursuant to the provisions of the "Urban Renewal
11 Consolidation Act of 1961", enacted by the Seventy-Second
12 General Assembly, the governing body of any municipality
13 having more than 25,000 inhabitants, as determined by the
14 last preceding Federal census, or of any county of this
15 State, may, by resolution, determine that there is need for a
16 Commission in such municipality or county to exercise the
17 powers and authority prescribed by this Act. Upon adoption,
18 such resolution shall be forwarded to the Department,
19 together with a statement of reasons or findings supporting
20 such resolution. The Department shall thereupon issue a
21 certificate to the presiding officer of such municipality or
22 county for the creation of such Commission if it shall find
23 that one or more slum or blighted areas exist in such
24 municipality or county. In determining whether slum or
25 blighted areas exist, the Department may take into
26 consideration the degree of over-crowding, the percentage of
27 land coverage, the light, air, space and access available to
28 the inhabitants or dwelling accommodations, the size and
29 arrangement of the rooms, the sanitary facilities, the age
30 and condition of the buildings and the extent to which
31 conditions exist in such buildings which endanger the life,

1 health, safety, morals and welfare of the occupants thereof.
2 No Commission shall be created for any municipality for and
3 in which there exists a Department of Urban Renewal created
4 pursuant to the provisions of the "Urban Renewal
5 Consolidation Act of 1961", enacted by the Seventy-Second
6 General Assembly.
