1 AN ACT to amend the Community Mental Health Act by
2 changing Section 3a.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Community Mental Health Act is amended by
6 changing Section 3a as follows:
7 (405 ILCS 20/3a) (from Ch. 91 1/2, par. 303a)
8 Sec. 3a. Every governmental unit authorized to levy an
9 annual tax under any of the provisions of this Act shall,
10 before it may levy such tax, establish a 7 member community
11 mental health board who shall administer this Act. Such
12 board shall be appointed by the chairman of the governing
13 body of a county, the mayor of a city, the president of a
14 village, the president of an incorporated town, or the
15 supervisor of a township, as the case may be, with the advice
16 and consent of the governing body of such county, city,
17 village, incorporated town or the town board of trustees of
18 any township. Members of the community mental health board
19 shall be residents of the government unit and, as nearly as
20 possible, be representative of interested groups of the
21 community such as local health departments, medical
22 societies, local comprehensive health planning agencies,
23 hospital boards, lay associations concerned with mental
24 health, developmental disabilities and substance abuse, as
25 well as the general public. A member of the governing body
26 shall be appointed as a member of the community mental health
27 board. Only one member of the governing body shall serve as
28 a member of the community mental health board Only one member
29 shall be a member of the governing body. The chairman of the
30 governing body may, upon the request of the community mental
31 health board, appoint 2 additional members to the community

1 mental health board. No member of the community mental
2 health board may be a full-time or part-time employee of the
3 Department of Human Services or a board member, employee or
4 any other individual receiving compensation from any facility
5 or service operating under contract to the board; except that
6 unpaid members of the board of directors of any
7 not-for-profit corporation operating under contract to
8 community mental health boards of 2 adjacent counties
9 established prior to 1979 may also be members of such
10 community mental health boards. If a successful referendum is
11 held under Section 5 of this Act, all members of such board
12 shall be appointed within 60 days of the referendum.
13 Home rule units are exempt from this Act. However, they
14 may, by ordinance, adopt the provisions of this Act, or any
15 portion thereof, that they may deem advisable.
16 The tax rate set forth in Section 4 may be levied by any
17 non-home rule unit only pursuant to the approval by the
18 voters at a referendum. Such referendum may have been held
19 at any time subsequent to the effective date of the Community
20 Mental Health Act.
