1 AMENDMENT TO HOUSE BILL 3132
2 AMENDMENT NO. . Amend House Bill 3132 by replacing
3 the title with the following:
4 "AN ACT concerning county officers."; and
5 by replacing everything after the enacting clause with the
6 following:
7 "Section 5. The Counties Code is amended by adding
8 Section 2-4006.5 as follows:
9 (55 ILCS 5/2-4006.5 new)
10 Sec. 2-4006.5. Commissioners in certain counties.
11 (a) If a county elects 3 commissioners at large under
12 Section 2-4006, registered voters of such county may, by a
13 vote of a majority of those voting on such proposition,
14 determine to increase the size of the board of county
15 commissioners to 5 members who shall be elected from single
16 member districts. In order for such question to be placed
17 upon the ballot, such petition must contain the signatures of
18 not fewer than 10% of the registered voters of such county.
19 The number of commissioners may not be increased and
20 commissioners may not be elected from single member districts
21 until the question of electing 5 commissioners from single

1 member districts has been submitted to the electors of the
2 county at a regular election and approved by a majority of
3 the electors voting on the question. The commissioners must
4 certify the question to the proper election authority, which
5 must submit the question at an election in accordance with
6 the Election Code.
7 The question must be in substantially the following form:
8 Shall the board of county commissioners of (name of
9 county) consist of 5 commissioners elected from single
10 member districts?
11 The votes must be recorded as "Yes" or "No"?.
12 If a majority of the electors voting on the question vote
13 in the affirmative, a 5-member board of county commissioners
14 shall be established to be elected from single member
15 districts.
16 (b) If the voters of the county decide to elect 5
17 commissioners from single member districts, the General
18 Assembly shall, by law, on or before August 31 of the year
19 following the 2000 federal decennial census divide the county
20 into 5 compact and contiguous county commission districts
21 that are substantially equal in population. On or before May
22 31 of the year following each federal decennial census
23 thereafter, the board of county commissioners shall
24 reapportion the county commission districts to be compact,
25 contiguous, and substantially equal in population.
26 (c) The commissioners elected at large at or before the
27 general election in 2000 shall continue to serve until the
28 expiration of their terms. Of those commissioners, the
29 commissioner whose term expires in 2002 shall be assigned to
30 district 1; the commissioner whose term expires in 2004 shall
31 be assigned to district 2; and the commissioner whose term
32 expires in 2006 shall be assigned to district 3.
33 (d) At the general election in 2002, one commissioner
34 from each of districts 1, 4, and 5 shall be elected. At the

1 general election in 2004, one commissioner from each of
2 districts 1, 2, and 5 shall be elected. At the general
3 election in 2006, one commissioner from each of districts 2,
4 3, and 4 shall be elected. At the general election in 2008,
5 one commissioner from each of districts 1, 3, and 5 shall be
6 elected. At the general election in 2010, one commissioner
7 from each of districts 2 and 4 shall be elected. At the
8 general election in 2012, commissioners from each district
9 shall be elected. Thereafter, commissioners shall be elected
10 at each general election to fill expired terms.
11 In the year following the decennial census of 2010 and
12 every 10 years thereafter, the commissioners, publicly by
13 lot, shall divide the districts into 2 groups. One group of
14 3 commissioners shall serve terms of 4 years, 4 years, and 2
15 years and one group of 2 commissioners shall serve terms of 2
16 years, 4 years, and 4 years.
17 Section 99. Effective date. This Act takes effect upon
18 becoming law.".
