1 AN ACT to amend the Environmental Protection Act.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended
5 by changing Section 19.2 as follows:
6 (415 ILCS 5/19.2) (from Ch. 111 1/2, par. 1019.2)
7 Sec. 19.2. Definitions. As used in this Title, unless the
8 context clearly requires otherwise:
9 (a) "Agency" means the Illinois Environmental Protection
10 Agency.
11 (b) "Fund" means the Water Revolving Fund created
12 pursuant to this Title, consisting of the Water Pollution
13 Control Loan Program, the Public Water Supply Loan Program,
14 and the Loan Support Program.
15 (c) "Loan" means a loan made from the Water Pollution
16 Control Loan Program or the Public Water Supply Loan Program
17 to an eligible applicant or a privately owned community water
18 supply as a result of a contractual agreement between the
19 Agency and such applicant or privately owned community water
20 supply.
21 (d) "Construction" means any one or more of the
22 following which is undertaken for a public purpose:
23 preliminary planning to determine the feasibility of the
24 treatment works or public water supply, engineering,
25 architectural, legal, fiscal or economic investigations or
26 studies, surveys, designs, plans, working drawings,
27 specifications, procedures or other necessary actions,
28 erection, building, acquisition, alteration, remodeling,
29 improvement or extension of treatment works or public water
30 supplies, or the inspection or supervision of any of the
31 foregoing items. "Construction" also includes implementation

1 of source water quality protection measures and establishment
2 and implementation of wellhead protection programs in
3 accordance with Section 1452(k)(1) of the federal Safe
4 Drinking Water Act.
5 (e) "Intended use plan" means a plan which includes a
6 description of the short and long term goals and objectives
7 of the Water Pollution Control Loan Program and the Public
8 Water Supply Loan Program, project categories, discharge
9 requirements, terms of financial assistance and the loan
10 applicants local government units and privately owned
11 community water supplies to be served.
12 (f) "Treatment works" means any devices and systems
13 owned by a local government unit and used in the storage,
14 treatment, recycling, and reclamation of sewerage or
15 industrial wastes of a liquid nature, including intercepting
16 sewers, outfall sewers, sewage collection systems, pumping
17 power and other equipment, and appurtenances; extensions,
18 improvements, remodeling, additions, and alterations thereof;
19 elements essential to provide a reliable recycled supply,
20 such as standby treatment units and clear well facilities;
21 and any works, including site acquisition of the land that
22 will be an integral part of the treatment process for
23 wastewater facilities.
24 (g) "Local government unit" means a county,
25 municipality, township, municipal or county sewerage or
26 utility authority, sanitary district, public water district,
27 improvement authority or any other political subdivision
28 whose primary purpose is to construct, operate and maintain
29 wastewater treatment facilities or public water supply
30 facilities or both.
31 (h) "Privately owned community water supply" means:
32 (1) an investor-owned water utility, if under
33 Illinois Commerce Commission regulation and operating as
34 a separate and distinct water utility;

1 (2) a not-for-profit water corporation, if
2 operating specifically as a water utility; and
3 (3) a mutually owned or cooperatively owned
4 community water system, if operating as a separate water
5 utility.
