1 AN ACT to amend the Illinois Library System Act by
2 changing Sections 8 and 8.4.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Library System Act is amended by
6 changing Sections 8 and 8.4 as follows:
7 (75 ILCS 10/8) (from Ch. 81, par. 118)
8 Sec. 8. State grants.
9 (a) There shall be a program of State grants within the
10 limitations of funds appropriated by the Illinois General
11 Assembly together with other funds made available by the
12 federal government or other sources for this purpose. This
13 program of State grants shall be administered by the State
14 Librarian in accordance with rules and regulations as
15 provided in Section 3 of this Act and shall include the
16 following: (i) annual equalization grants; (ii) Library
17 System grants; (iii) annual grants to Research and Reference
18 Centers; (iv) per capita grants to public libraries; and (v)
19 planning and construction grants to public libraries and
20 library systems. Libraries, in order to be eligible for
21 grants under this Section, must be members of a library
22 system.
23 (b) An annual grant shall be made to all public
24 libraries for which the corporate authorities levy a tax for
25 all library purposes at a rate not less than .13% of the
26 value of all taxable property as equalized and assessed by
27 the Department of Revenue if the amount of the tax revenue
28 produces less than $7.50 per capita and at least 10% of the
29 population territory of the library has a personal income at
30 or below the poverty level as determined by the U.S.
31 Department of Commerce Bureau of Census. These libraries

1 shall be eligible for a grant equivalent to the difference
2 between the amount obtained from a rate of .13% of the value
3 of all taxable property and an annual income of $7.50 per
4 capita. A library that receives a grant under this paragraph
5 that reduces the tax levy below the amount levied at the time
6 the original application is approved shall be ineligible to
7 receive further equalization grants until the levy is
8 increased to or exceeds the rate at which the levy was set at
9 the time the original grant application was approved. An
10 annual equalization grant shall be made to all public
11 libraries for which the corporate authorities levy a tax for
12 library purposes at a rate not less than .13% of the value
13 of all the taxable property as equalized and assessed by the
14 Department of Revenue if the amount of tax revenue obtained
15 from a rate of .13% produces less than $4.25 per capita. In
16 that case, the State Librarian is authorized to make an
17 equalization grant equivalent to the difference between the
18 amount obtained from a rate of .13% and an annual income of
19 $4.25 per capita. If a library receiving an equalization
20 grant reduces its tax levy below the amount levied at the
21 time the original application is approved, it shall be
22 ineligible to receive further equalization grants.
23 If a library is subject to the Property Tax Extension
24 Limitation Law in the Property Tax Code and its tax levy for
25 library purposes has been lowered to a rate of less than
26 .13%, the library will qualify for this grant if the library
27 levied a tax for library purposes that met the requirements
28 for this grant in the previous year and if the tax levied for
29 library purposes in the current year produces tax revenue for
30 the library that is an increase over the previous year's
31 extension of 5% or the percentage increase in the Consumer
32 Price Index, whichever is less, and the tax revenue produced
33 by this levy is less than $7.50 $4.25 per capita. In this
34 case, the State Librarian is authorized to make an

1 equalization grant equivalent to the difference between the
2 amount of tax revenue obtained from the current levy and an
3 annual income of $7.50 $4.25 per capita. If a library
4 receiving an equalization grant reduces its tax levy below
5 the amount levied at the time the original application is
6 approved, it shall be ineligible to receive further
7 equalization grants.
8 (c) Annual Library System grants shall be made, upon
9 application, to each library system approved by the State
10 Librarian on the following basis:
11 (0.5) The distribution of annual library system
12 grants, from all fund sources for this purpose, at the
13 rate of 90% for distribution by means of area and per
14 capita served, as provided in paragraph (1) of this
15 subsection. Additionally, the remaining 10% of funds
16 available for annual library system grants shall be made
17 available for distribution based upon approved
18 application, by the State Librarian, for the provision of
19 services to member libraries and for technological
20 developments.
21 (1) For cooperative public library systems, public
22 library systems, or multitype library systems, the sum of
23 $1.46 per capita of the population of the area served
24 plus the sum of $50.75 per square mile or fraction
25 thereof of the area served.
26 (2) If the amounts appropriated for grants is
27 different from the amount provided for in paragraph (1)
28 of this subsection, the area and per capita funding shall
29 be proportionately reduced or increased accordingly.
30 Remaining funding comprising 10% of the annual library
31 systems grants shall be distributed upon approval of
32 application for initiatives of library development and
33 technological innovations according to rules and
34 regulations promulgated by the State Librarian on

1 criteria for awarding the grants.
2 (3) For multitype library systems, additional funds
3 may be appropriated. The appropriation shall be
4 distributed on the same proportional per capita and per
5 square mile basis as provided in paragraph (1) of this
6 subsection.
7 (d) The "area served" for the purposes of this Act means
8 the area that lies within the geographic boundaries of the
9 library system as approved by the State Librarian. In
10 determining the population of the area served by the library
11 system, the Illinois State Library shall use the latest
12 federal census for the political subdivisions in the area
13 served.
14 (e) In order to be eligible for a grant under this
15 Section, the corporate authorities, instead of a tax levy at
16 a particular rate, may provide from a source other than
17 federal revenue sharing an amount equivalent to the amount
18 produced by that levy.

21 Sec. 8.4. School library grants. Beginning July 1,
22 1989, the State Librarian shall make grants annually under
23 this Section to all school districts in the State for the
24 establishment and operation of qualified school libraries, or
25 the additional support of existing qualified school
26 libraries, from funds appropriated by the General Assembly.
27 Such grants shall be in the amount of $1.25 $0.75 per student
28 as determined by the official enrollment as of the previous
29 September 30 of the respective school having a qualified
30 school library. If the moneys appropriated for grants under
31 this Section are not sufficient, the State Librarian shall
32 reduce the amount of the grants as necessary; in making these
33 reductions, the State Librarian shall endeavor to provide

1 each school district that has a qualifying school library (i)
2 at least the same amount per student as the district received
3 under this Section in the preceding fiscal year, and (ii) a
4 total grant of at least $100.
5 To qualify for grants under this Section, a school
6 library must:
7 (1) Be an entity which serves the basic information
8 and library needs of the school's employees and students
9 through a bibliographically organized collection of
10 library materials, has at least one employee whose
11 primary duty is to serve as a librarian, and has a
12 collection permanently supported financially, accessible
13 centrally, and occupying identifiable quarters in one
14 principal location.
15 (2) Meet the requirements for membership in a
16 library system under the provisions of this Act.
17 (3) Have applied for membership in the library
18 system of jurisdiction if the system is a multitype
19 library system under this Act.
20 (4) Provide, as mutually determined by the Illinois
21 State Librarian and the Illinois State Board of
22 Education, library services which either meet or show
23 progress toward meeting the Illinois school library
24 standards as most recently adopted by the Illinois School
25 Library Media Association.
26 (5) Submit a statement certifying that the
27 financial support for the school library or libraries of
28 the applying school district has been maintained
29 undiminished, or if diminished, the percentage of
30 diminution of financial support is no more than the
31 percentage of diminution of the applying school's total
32 financial support for educational and operations purposes
33 since the submission of the last previous application of
34 the school district for the school library per student

1 grant that was funded.
2 Grants under this Section shall be made only upon
3 application of the school district for its qualified school
4 library or school libraries.

6 Section 99. Effective date. This Act takes effect upon
7 becoming law.
