1 AN ACT to amend the Illinois Vehicle Code by changing
2 Section 15-101.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Vehicle Code is amended by
6 changing Section 15-101 as follows:
7 (625 ILCS 5/15-101) (from Ch. 95 1/2, par. 15-101)
8 Sec. 15-101. Scope and effect of Chapter 15. (a) It is
9 unlawful for any person to drive or move on, upon or across
10 or for the owner to cause or knowingly permit to be driven or
11 moved on, upon or across any highway any vehicle or vehicles
12 of a size and weight exceeding the limitations stated in this
13 Chapter or otherwise in violation of this Chapter, and the
14 maximum size and weight of vehicles herein specified shall be
15 lawful throughout this State, and local authorities shall
16 have no power or authority to alter such limitations except
17 as express authority may be granted in this Chapter.
18 (b) The provisions of this Chapter governing size,
19 weight and load do not apply to fire apparatus or equipment
20 for snow and ice removal operations owned or operated by any
21 governmental body, or to implements of husbandry temporarily
22 operated or towed in a combination upon a highway provided
23 such combination does not consist of more than 3 vehicles or,
24 in the case of hauling fresh, perishable fruits or vegetables
25 from farm to the point of first processing, not more than 3
26 wagons being towed by an implement of husbandry, or to a
27 vehicle operated under the terms of a special permit issued
28 hereunder.
29 (c) A home rule unit may not adopt local police or truck
30 regulations or assess fines that are not identical in
31 substance with the provisions of this Chapter, except when

1 express authority to do so is granted in this Chapter. This
2 Section is a limitation under subsection (i) of Section 6 of
3 Article VII of the Illinois Constitution on the concurrent
4 exercise by home rule units of powers and functions exercised
5 by the State.

7 Section 99. Effective date. This Act takes effect upon
8 becoming law.
