1 AN ACT to create the Local Planning Technical Assistance
2 Act.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 1. Short title. This Act may be cited as the
6 Local Planning Technical Assistance Act.
7 Section 5. Purposes. The purposes of this Act are to:
8 (a) Define and disseminate the principles of
9 sensible planning.
10 (b) Encourage counties and municipalities to engage
11 in planning, regulatory, and development approaches and
12 techniques that conform to the principles of sensible
13 planning.
14 (c) Provide demonstration grants to counties and
15 municipalities to prepare and implement comprehensive
16 plans, zoning ordinances, subdivision controls, other
17 land development regulations, and development incentives
18 that conform to the principles of sensible planning.
19 (d) Prepare and distribute model ordinances,
20 manuals, and other technical publications that are
21 founded upon and promote the principles of sensible
22 planning.
23 (e) Research and report upon the results and impact
24 of activities funded by the demonstration grants.
25 Section 10. Sensible Planning. "Sensible planning"
26 consists of planning, regulatory, and development practices
27 and techniques founded upon and promoting the following
28 principles:
29 (a) Using land resources more efficiently through
30 compact building forms, infill development, and

1 moderation in street and parking standards to lessen land
2 consumption and preserve natural resources.
3 (b) Supporting the location of stores, offices,
4 residences, schools, recreational spaces, and other
5 public facilities within walking distance of each other
6 in compact neighborhoods to provide opportunities for
7 easier movement and interaction.
8 (c) Providing a variety of housing choices, so that
9 the young and old, single persons and families, and those
10 of varying economic ability may find places to live.
11 (d) Supporting walking, cycling, and transit as
12 attractive alternatives to driving, providing alternative
13 routes that disperse, rather than concentrate, traffic
14 congestion, and lowering traffic speeds in neighborhoods.
15 (e) Connecting infrastructure and development
16 decisions to minimize future costs by creating
17 neighborhoods where more people use existing services and
18 facilities, and by integrating development and land use
19 with transit routes and stations.
20 (f) Improving the development review process and
21 development standards so that developers are encouraged
22 to apply the principles stated in this Section.
23 Section 15. Definitions. As used in this Act:
24 "Comprehensive plan" means a regional plan under Section
25 5-14001 of the Counties Code, official comprehensive plan
26 under Section 11-12-6 of the Illinois Municipal Code, or
27 local land resource management plan under Section 3 of the
28 Local Land Resource Management Planning Act.
29 "Department" means the Department of Commerce and
30 Community Affairs.
31 "Land development regulation" means any ordinance or
32 regulation of a county or municipality that regulates
33 development and land use, including, but not limited to,

1 zoning and subdivision ordinances.
2 "Municipality" means any city, village, or incorporated
3 town.
4 "Subsidiary plan" means any plan, other than a
5 comprehensive plan, that guides development, land use, and
6 infrastructure for a county or municipality, or a portion of
7 the county or municipality.
8 Section 20. Technical assistance grants.
9 (a) The Department may make grants to counties and
10 municipalities to develop, update, administer, and implement
11 comprehensive plans, subsidiary plans, land development
12 regulations, and development incentives that conform to the
13 principles of sensible planning.
14 (b) The Department must adopt rules establishing
15 standards and procedures for determining eligibility for the
16 grants, regulating the use of funds under the grants, and
17 requiring periodic reporting of the results and impact of
18 activities funded by the grants.
19 (c) No individual grant under this Act may have a
20 duration of more than 24 months.
21 (d) The Department, in the determination of grantees,
22 must take into consideration communities with limited means
23 to support local planning efforts. The Department must also
24 seek an even balance of grants within metropolitan regions.
25 Section 25. Model ordinances and technical publications.
26 (a) The Department may prepare model ordinances,
27 manuals, and other technical publications that are founded
28 upon and promote the principles of sensible planning. The
29 Department must make all possible use of existing model
30 ordinances, manuals, and other technical publications
31 prepared by regional planning agencies and commissions,
32 councils of government and other organizations, which

1 materials shall conform to the principles of sensible
2 planning.
3 (b) The Department may employ or retain private
4 for-profit or not-for profit entities, regional planning
5 agencies and commissions, councils of government, and
6 universities to advise, prepare, or conduct the preparation
7 of the model ordinances, manuals, and other technical
8 publications.
9 (c) The Department must distribute any model ordinances,
10 manuals, and other technical publications prepared under this
11 Section to all counties and municipalities, regional planning
12 agencies and commissions, the Illinois State Library, all
13 local public libraries, and to other organizations and
14 libraries at the Department's discretion.
15 Section 30. Educational and training programs.
16 (a) The Department may provide educational and training
17 programs in planning, regulatory, and development practices
18 and techniques founded upon and promoting the principles of
19 sensible planning, including, but not limited to, the use and
20 application of any model ordinances, manuals, and other
21 technical publications prepared by the Department.
22 (b) The Department may employ or retain private
23 for-profit and not-for-profit entities, regional planning
24 agencies and commissions, and universities to operate or
25 conduct, or assist in the operation or conduct of, the
26 programs.
27 Section 35. Annual report. The Department must, at
28 least annually but more often at its discretion, report in
29 writing to the Governor and General Assembly on:
30 (a) The results and impacts of county and municipal
31 activities funded by the grants authorized by this Act,
32 with a focus upon those planning, regulatory, and

1 development practices and techniques that have
2 successfully implemented the principles of sensible
3 planning.
4 (b) The distribution of the grants.
5 (c) Model ordinances, manuals, and other technical
6 publications prepared by the Department.
7 (d) Educational and training programs provided by
8 the Department.
9 The report must also be provided to all counties and
10 municipalities, regional planning agencies and commissions,
11 the Illinois State Library, all local public libraries, and
12 to other organizations and libraries at the Department's
13 discretion.
14 Section 40. Local Planning Technical Assistance Fund.
15 The Department must use moneys appropriated to the Local
16 Planning Technical Assistance Fund, a special fund created in
17 the State Treasury, to implement and administer the purposes
18 of this Act.
19 Section 105. The State Finance Act is amended by adding
20 Section 5.541 as follows:
21 (30 ILCS 105/5.541 new)
22 Sec. 5.541. The Local Planning Technical Assistance
23 Fund.
24 Section 999. Effective date. This Act takes effect upon
25 becoming law.
