1 AN ACT to amend the School Code by changing Sections
2 10-22.18b and 34-18.4.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The School Code is amended by changing
6 Sections 10-22.18b and 34-18.4 as follows:
7 (105 ILCS 5/10-22.18b) (from Ch. 122, par. 10-22.18b)
8 Sec. 10-22.18b. Before and after school programs;
9 grants.
10 (a) To develop and maintain before school and after
11 school programs for students in kindergarten through the 6th
12 grade. Such programs may include time for homework, physical
13 exercise, afternoon nutritional snacks and educational
14 offerings which are in addition to those offered during the
15 regular school day. The chief administrator in each district
16 shall be a certified teacher or a person who meets the
17 requirements for supervising a day care center under the
18 Child Care Act of 1969. Individual programs shall be
19 coordinated by certified teachers or by persons who meet the
20 requirements for supervising a day care center under the
21 Child Care Act of 1969. Additional employees who are not so
22 qualified may also be employed for such programs.
23 The schedule of these programs may follow the work
24 calendar of the local community rather than the regular
25 school calendar. Parents or guardians of the participating
26 students shall be responsible for providing transportation
27 for the students to and from the programs. The school board
28 may charge parents of participating students a fee, not to
29 exceed the actual cost of such before and after school
30 programs.
31 (b) The State Board of Education shall provide after

1 school program grants to qualifying school districts, as
2 determined by the State Board of Education, for the purpose
3 of assisting individual students who fail to meet State
4 academic standards, as determined under Section 2-3.64 of
5 this Code, and their families at the end of the regular day
6 of instruction or on non-school days at school sites in the
7 qualifying school district.
8 The State Board of Education may adopt any rules
9 necessary to carry out its responsibilities under this
10 subsection (b).

15 Section 99. Effective date. This Act takes effect upon
